Property Management fined me wrongfully for subleasing. How can I cancel the fine?

Property Management fined me for subleasing.

I am a tenant of [----] and one day, a member of an inspection team visited my apartment, my friend was there and they accused me of giving the apartment on sublease. They took a picture of both our Emirates IDs and fined us AED 8,020 for subleasing the unit.

My friend is living in company-provided accommodation and I have provided a letter from her company for the same but [----] is not accepting it and forcing me to pay the fine.

Kindly advise, what can I do in such a case?

Thanks

Dear client,

To address the fine imposed by the Property Management for alleged subleasing, you should resubmit the letter from your friend's employer to clarify that she lives in company-provided accommodation and was merely visiting.

Formally request a review of the fine, emphasizing your evidence and the misunderstanding. If [---] refuses to reconsider, it may be beneficial to consult with us for further assistance.

Be sure to document all communications in case you need to pursue legal action later.

Thanks

From the above explanation, it's clear that your friend is living in the company accommodation.

So the management company cannot impose a fine on subleasing.

Now you may respond to them by an official email attaching those proofs and try to settle this situation.

If you need further clarification, kindly share your WhatsApp number.

Dear Questioner,

Good morning.

To address the fine for alleged subleasing imposed by Al Wasl Properties, you can take the following steps:

1. File a Dispute with Dubai Rental Disputes Center (RDC): If Property Management refuses to accept your evidence, you can escalate the matter to the RDC. Submit the company letter confirming your friend's residency along with any additional proof showing that no subleasing occurred.

2. Provide Additional Evidence: Collect supporting evidence, such as rent payment receipts showing payments made solely by you or proof of your friend's residency arrangement with their company.

3. Negotiate Further: Before filing a dispute, you may send a formal legal notice requesting [----] to reconsider the fine based on your documentation.

For assistance with drafting the legal notice or representing you in the dispute process, feel free to contact us:

Collect any evidence that supports your claim that your friend was simply a guest in your apartment.

Submit a formal written complaint to Property Management, outlining the situation and providing the evidence you have gathered.

Request a review of the fine and a cancellation of the penalty. If they do not respond to your complaint or refuse to cancel the fine, you can file a complaint with RDC - RERA.

Check your lease with Property Management for clauses relating to:

- Subletting the apartment.

- Number of people allowed to stay.

- Fines or penalties for breach of terms.

If there is no clear indication of a fine being imposed in such a case, imposing the fine may be illegal.
