How much prison time does someone face for being an absconder?

Hi,

If someone gets jailed due to being an absconder and has rental agreement defaults as well, how much prison time will he get for the absconding status?

Will they send him to his home country without clearing the rental agreement?

Let me know.

Thanks!

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

If someone is jailed for being an absconder, the prison time can vary based on the case's specifics, but it may lead to deportation without resolving rental agreements.

Typically, the individual may face fines and a travel ban, but they cannot be forced to resolve financial obligations before deportation.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

Dear Questioner,

Under UAE laws, absconding cases and rental agreement defaults are treated separately but can have overlapping consequences.

Typically, rental debts must be cleared before deportation unless the court decides otherwise.

Dear Questioner,

According to UAE law, absconding is considered a criminal offense and can result in imprisonment for up to six months and/or a fine.

The length of imprisonment may vary depending on the circumstances and severity of the case.

As for the rental agreement default, the landlord has the right to file a case against the tenant for non-payment of rent.

If the tenant is found guilty, they may face imprisonment for up to three years and/or a fine. However, if the tenant is already in jail for absconding, the court may consider this as a mitigating factor and may reduce the sentence.

In terms of deportation, the UAE authorities may deport the individual after they have served their sentence for absconding.

However, the individual may still be required to settle any outstanding debts or legal obligations, such as the rental agreement default, before being allowed to leave the country.

Dear Questioner,

In the event that a travel ban order and a deportation order are issued from the Emirates, the matter will be presented to a specialized committee to determine which of the two decisions should be implemented.

If someone is jailed due to absconding status and has outstanding rental agreements, they may be detained until their legal situation is resolved.

Typically, they will be required to settle any financial obligations before being deported to their home country.
