How can I remove my ex-partner from the title deed after removing her from the mortgage?
Dear Sir/Madam,
I have a property that was originally joint mortgaged by me and my soon-to-be ex-partner. I have removed her from the mortgage and now need to remove her from the title deed.
I have attempted the process with the DLD but have not made much progress and am seeking advice.
Dear Sir,
You refer to the title deed, which means that she is also the owner of the property and that the property is jointly owned between you. You can remove her name either by mutual agreement or through legal action.
- By mutual agreement: You can offer to purchase her share for an agreed amount.
- Through legal action: You can file a partition suit to separate your share. If partition is not possible, the property will be put up for sale, and you can buy her share, then register your name with the Land Department as the sole owner with 100% ownership.

Dear Questioner,
Removing your ex-partner from the title deed of a property in the UAE can be a complex process, especially if you're facing difficulties with the Dubai Land Department (DLD).
Submit the completed application form along with the required documents to the DLD. Make sure of the required documents.
Monitor the progress of your application and follow up with the DLD regularly to ensure there are no delays or issues.
It will be better if you seek the assistance of a lawyer to handle the procedures.

Since you mentioned that your ex-partner has been removed from the mortgage, ensure that all formalities with the mortgage lender are complete and that there are no outstanding issues with the mortgage company.
Some mortgage providers may require you to get a no-objection certificate, or NOC, stating that the mortgage has been settled and that they have no objection to removing your ex-partner from the title deed.
You should have a written agreement (preferably notarized) from your ex-partner agreeing to the removal of their name from the title deed.
This document should confirm that your ex-partner is relinquishing any claims to the property.
Provide evidence that your ex-partner has been removed from the mortgage, such as a bank statement or a revised mortgage agreement reflecting only your name.
Once you have all the necessary documents, you will need to submit them to the Dubai Land Department (DLD), and DLD will process your request.

As per Article 19 of the Dubai Land Department (DLD) Resolution No. 3 of 2006, the procedure for removing a name from the title deed is as follows:
1. The parties must first approach the DLD and submit a request to remove the name of the ex-partner from the title deed.
2. The DLD will then issue a notice to the ex-partner, giving them 30 days to raise any objections to the removal of their name from the title deed.
3. If the ex-partner does not raise any objections within the 30-day period, the DLD will proceed with removing their name from the title deed.
4. If the ex-partner does raise objections, the DLD will schedule a hearing to resolve the dispute.
