I bought second-hand a car from a showroom and discovered a major damage. What can I do?

Hello,

I bought a second-hand car from a showroom based in the Ras Al Khor area.

When the car was taken to care in service I learned that the car had an accident that was around AED 206K. I bought the car for AED 133K also.

They did not say anything about the accident and when I checked the car according to the plate number, there was not any notification online.

I have been in Dubai for around 1 year and I do not know what should I do right now. The car brand is [----] - 2021.

I fully understand your concern about discovering that your used car was involved in a previous accident with a high repair cost, without being informed of this upon purchase.

In the UAE, consumers have the right to receive accurate and transparent information about the products they purchase, including used cars.

Suggested steps to deal with the situation:

Gather evidence:

Obtain a detailed report from the service center showing the condition of the car, previous damages, and repair costs.

Retain all documents related to the purchase, such as the sales contract, receipts, and any correspondence with the showroom.

Contact the showroom:

Visit the showroom and ask to meet the officials to explain the situation and provide the evidence you have.

Ask them to provide an appropriate solution, such as replacing the car or refunding the amount paid.

Filing a formal complaint:

If you do not reach a satisfactory solution with the showroom, you can file a complaint with the relevant authorities:

Dubai Department of Economic Development (DED):

The department provides a complaints service through its website.

Filing a complaint link: Register a complaint | Department of Economic Development - Dubai

Ministry of Economy:

You can file a complaint through the ministry’s website.

Filing a complaint link: Consumer Complaints Service | Ministry of Economy - United Arab Emirates

Legal Consultation:

Please contact us via phone or WhatsApp.

Hello,

Under the UAE Consumer Protection Law, it is illegal for a seller to misrepresent a product, including failing to disclose critical information like prior accidents or damage.

If the showroom did not disclose this information when selling you the car, they are in breach of this law.

You can file a formal complaint with the UAE Ministry of Economy’s Consumer Protection Department.

This body is responsible for handling consumer disputes and can investigate whether the showroom violated any consumer protection laws.

For a detailed discussion, kindly share your Whatsapp number.

We understand your concerns. Gather all relevant documents, including the purchase agreement, service reports, and any communication with the showroom.

Take photos of the car's damage and the repair estimates.

We can send them a legal notice for breach of contract and for breach of trust and can claim the refund as well.

Kindly share your WhatsApp number to discuss further about the procedures.

Dear Sir,

You can contact us to take the necessary steps to terminate the contract and provide us with proof of payment for the vehicle, whether through a receipt or bank transfer, to confirm that you have paid the value of the vehicle.

We will also need a report issued by the service center, which must be certified, along with your right to claim compensation and legal interest.

Thank you for reaching out regarding your recent purchase of a 2021 [---] car. It's concerning to learn that the vehicle had a significant accident history amounting to AED 206,000, which was not disclosed at the time of sale.

Under the UAE's Federal Law No. 15 of 2020 on Consumer Protection, sellers are obligated to provide accurate information about the products they sell, including any history of accidents or major repairs. Failure to disclose such critical information constitutes a violation of consumer rights.

Given your situation, you have the right to take the following steps:

File a Complaint: Submit a formal complaint to the Department of Economic Development (DED) in Dubai, detailing the undisclosed accident history and any supporting evidence.

Seek Legal Action: If the issue remains unresolved, you may consider pursuing legal action against the dealership for misrepresentation and breach of consumer protection laws.

I would be glad to assist you in navigating this process to ensure your rights are upheld and to seek appropriate remedies.

Please feel free to contact me via WhatsApp or phone to discuss your case in detail and explore the best course of action.

Best regards,

Suhail Rana
