"In absentia" refers to a legal proceeding in which the accused is not physically present in court.

This can happen if the accused is unable to attend the trial due to illness, travel restrictions, or other reasons.

In this case, the Public Prosecution has requested that the accused be convicted and the trial proceed without their physical presence.

This means that the trial will continue and a verdict will be issued even if the accused is not present in court.

The decision to proceed in absentia is made by the court based on the circumstances of the case.

That the accused didn't attend the session and the court gave an order in his absence.

Hello,

In criminal cases, the complaint is submitted to the Public Prosecution, which is responsible for determining how to proceed.

The prosecution may either dismiss the case or refer it to the court through a referral order.

This referral order outlines the charges against the accused and specifies the legal provisions under which the crimes are punishable.

Subsequently, the court will examine the case and issue its judgment.

Dear Questioner,

In the UAE legal system, the Public Prosecution is responsible for investigating and prosecuting criminal cases.

When the Public Prosecution requests that the accused be convicted and their trial proceed in absentia, it means that they are asking the court to proceed with the trial even if the accused is not physically present in court.

This can happen if the accused is not able to attend the trial due to being outside the country, in hiding, or for other reasons.

The Public Prosecution may make this request if they believe there is enough evidence to convict the accused and that it is in the best interest of justice to proceed with the trial in their absence.

The court will then make a decision on whether to proceed with the trial in absentia or to postpone it until the accused can be present.
