What legal steps can I take if a security cheque is deposited without a prior notice?
Hello,
I hope you can assist me with legal advice concerning a cheque-related issue in Abu Dhabi.
I issued a security cheque for AED 2,000 as part of a short-term rental contract for the period from 08/03/2024 to 07/05/2024. The cheque was blank-dated and provided solely as a security deposit.
However, after four months yesterday, the cheque was deposited by the payee without prior communication, documentation, or an accompanying invoice. Despite multiple attempts to contact the payee, I have not received any response.
Given the situation, I would like advice on the legal options available to me within the Abu Dhabi jurisdiction. Specifically:
What legal steps can I take if a security cheque is deposited without proper documentation or prior notice?
Are there specific regulations or precedents in Abu Dhabi regarding such cases?
I appreciate any guidance you can provide on how to approach this matter.
Thank you for your assistance.
Thank you for reaching out to me with your inquiry regarding the cheque-related issue in Abu Dhabi.
I understand how concerning it must be to have a security cheque deposited unexpectedly without communication or proper documentation.
Regarding your situation:
Legal Steps for Security Cheque Deposit:
In cases where a security cheque has been deposited without prior notice or supporting documentation, you may have the right to contest the cheque.
Abu Dhabi courts do recognize disputes involving misuse of cheques, and if the cheque was issued as a security deposit and not intended for cashing without proper cause, you may have grounds to challenge its validity.
Filing a complaint through the police or initiating a civil case could be viable steps.
Regulations & Precedents in Abu Dhabi:
The UAE does have stringent laws regarding cheque misuse. The Commercial Transactions Law and the UAE’s Penal Code impose penalties for the wrongful use of cheques, and there have been precedents where the courts ruled in favor of individuals whose security cheques were cashed without justification.
I recommend we discuss the specifics of your case further, as the details surrounding the rental agreement and any communications with the payee could play an important role in determining the best course of action.
We can review the documentation and explore the possibility of stopping the cheque or seeking redress through legal means.
Please feel free to reach out to me directly via WhatsApp by phone or give me a call to discuss the matter further. You can also email me if you prefer.
Looking forward to assisting you.
Best regards,
Suhail Rana
Hello,
We can send a formal legal notice to the payee demanding an explanation and return of the cheque amount. This can serve as evidence that you are trying to resolve the issue amicably before pursuing formal legal action.
You may need to file a case with the Abu Dhabi Courts to dispute the legitimacy of cashing the cheque, especially if no invoice or demand notice was provided.
The court can investigate whether the cheque was misused. If the cheque bounces, the payee may try to initiate a criminal complaint against you for a bounced cheque, which is a criminal offense under UAE law.
You will need to argue that the cheque was cashed in bad faith.
According to UAE law, a security cheque is considered a guarantee for the fulfillment of a contractual obligation.
In your case, the cheque was provided as a security deposit for the rental contract. Therefore, the payee is not allowed to deposit the cheque without proper documentation or prior notice.
If the payee has deposited the cheque without your consent or without fulfilling their contractual obligations, you have the right to file a complaint with the police or the public prosecution.
You can also file a civil case against the payee for breach of contract and misuse of the security cheque.

Dear Inquirer
Legal Steps:
Contact the Bank: Notify the bank that the cheque withdrawal is unauthorized and request to stop it if possible.
File a Complaint: You can file a complaint with the Abu Dhabi Judicial Department regarding the cheque being deposited without consent. Ensure you have a copy of the rental agreement and previous correspondence. It is best to have a lawyer present to prevent any risks that may occur
If you need further clarification, you can contact us.
