The car rental company charged me extra amounts without proof. What can I do?

I'm currently renting a car monthly. The monthly fee, full insurance, and deposit (1K AED) are paid.

During the middle of the agreement, they charged me AED 925 without any previous notice. I checked for fines and the car looked clean, no fines.

I contacted my bank and froze my credit card, but they asked me to contact the company first. As I already had transactions with them.

The car rental made me wait 3 days to get the information, but they finally sent me proof of a fine with the plate number, date, and time, but without the location.

The fine was AED 800, but they charged me AED 925. When asking about the price difference, they said that there are some salik charges too.

Police say that they cannot do anything because the fine is already paid.

My question is, can they really take from the credit card like that if I already paid a deposit for this kind of charge?

How legal is it that they pay the fine without notifying me, and without giving me the chance to review the fine beforehand?

Go through the terms of the rental contract, focusing on the sections about fines, deposits, and additional charges.

Check if it mentions their right to directly charge your credit card or whether they must use the deposit first.

If the agreement doesn’t explicitly mention that they can charge your credit card without prior notice and without giving you a chance to review the fine, you could challenge this charge.

If you need further clarification, kindly share your whatsapp number.

Hey,

The contract doesn't directly say anything about how "they can charge your credit card without prior notice and without giving you a chance to review the fine"

Please find my WhatsApp number [-----].

Dear C.,

Thanks for your inquiry.

According to UAE law, car rental companies are allowed to charge for any fines or violations incurred during the rental period.

However, they are required to inform the customer and provide proof of the fine before charging them.

In your case, it seems that the car rental company did not follow this procedure and charged you without prior notice or proof of the fine.

Additionally, it is not clear why they charged you AED 925 instead of the actual fine amount of 800 AED.

It is important to note that car rental companies are not allowed to charge any additional fees or markups on top of the actual fine amount.

If they have done so, it may be considered a violation of consumer rights.

In this situation, you have the right to dispute the charges and request a breakdown of the fees from the car rental company.

You can also file a complaint with the relevant consumer protection authority in your emirate.

It is recommended to seek legal advice from us as a lawyer in this matter to understand your rights and options.

Kindly do not hesitate to contact us by email or phone for further guidance.

Greetings
