Can we legally dispose of tenants' personal belongings left in common areas?

Dear Questioner,

We are a company that owns a residential complex in the city of Al Ain, and tenants sometimes place their personal belongings in the corridors, which affects the general appearance, such as shoes, bicycles, etc.

We always send them notices after they commit this act, and we have set regulations at the entrance to the building that prohibit it.

Do we have the right to do this? Should we notify the tenant before disposing of any of their personal belongings, or is it not permissible for us to do so?

Dear Questioner,

As a company that owns a residential complex, you have the right to set regulations for the use of common areas, including corridors.

These regulations can include rules about not leaving personal belongings in the corridors.

If a tenant violates these regulations, you have the right to send them a notice and request that they remove their belongings.

If they continue to violate the regulations, you may have the right to dispose of their belongings after giving them a reasonable amount of time to remove them.

However, it is important to check with local laws and regulations to ensure that you are following proper procedures for disposing of personal belongings.

In some cases, you may be required to give a specific notice period or obtain a court order before disposing of the belongings.

It is also advisable to notify the tenant before disposing of their belongings, as a courtesy and to avoid any potential legal issues. You can do this through a written notice or by posting a notice in a visible area in the building.

In summary, you have the right to set regulations for the use of common areas and to enforce them by sending notices and disposing of personal belongings if necessary.

However, it is important to follow proper procedures and notify the tenant before taking any action.

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, according to the UAE Civil Code, the owner of a property has the right to manage and dispose of the property as they see fit, as long as it does not violate any laws or regulations.

This includes the right to regulate the use of common areas, such as corridors, in a residential complex.

In this case, it is within your rights as the owner of the residential complex to set regulations for the use of common areas and to enforce them.

This includes notifying tenants about their personal belongings left in the corridors and taking action to remove them if necessary.

However, it is important to follow proper procedures and give tenants sufficient notice before disposing of their belongings. This can include sending written notices and giving them a reasonable amount of time to remove their belongings before taking any action.

It is also advisable to consult with us at [------] as a legal professional to ensure that your regulations and actions are in line with UAE laws and regulations.

Greetings,

As the owner of the residential complex, you have the right to set regulations regarding the use of common areas, including the corridors.

If you have clearly stated in the entrance regulations that personal belongings cannot be placed in the corridors, you have the right to enforce this rule.

However, before disposing of any tenant's personal belongings, it is important to follow proper legal procedures.

You should notify the tenant in writing that their belongings have been found in violation of the regulations and give them a reasonable amount of time to remove them.

If the tenant does not comply with the notice, you may then have the right to dispose of the belongings.

It is always advisable to seek legal assistance or consult with a property management professional to ensure you are following the correct procedures and not infringing on the tenant's rights.

Yes, you have the right to do so, as they are paying to rent the apartments, not the hallways.

You can also refer to municipal regulations regarding cleanliness and general appearance in this context.
