My employer won't accept my resignation or return my passport. What are my options?
Good evening, Mam/Sir,
I have been working at a contracting company for almost 1.5 years. Recently, I received an offer letter from another company, and I have decided to pursue this new opportunity.
I submitted my resignation with a notice period of 10 days. However, my employer is not allowing me to resign and has not returned my passport.
Hello,
Review your employment contract. UAE law mandates a minimum 30-day notice period, but your contract might specify a longer duration (up to 90 days).
Check your contract to know the valid notice period. Employers in the UAE cannot hold employees' passports. Contact MOHRE to file a complaint for violating your rights.
For further clarification, kindly share your WhatsApp number.
Greetings,
He has no right to reject the resignation as no one is forced to work, and you can file a complaint with the Ministry of Human Resources and Emiratisation to terminate your employment.
You can submit a request for an order on a petition to the judge of urgent matters to obtain your passport as the passport is a personal document and no one but its owner has the right to keep it

Under labor laws, your employer has no right to hold on to your passport even if you have submitted your resignation.

It is always best to handle resignations professionally and within the agreed notice period, but it is ultimately your right to resign from a job and pursue new opportunities.
Stay firm in your decision and seek legal advice if necessary to protect your rights.
Good luck with your new job!
