My employer won't accept my resignation or return my passport. What are my options?

Good evening, Mam/Sir,

I have been working at a contracting company for almost 1.5 years. Recently, I received an offer letter from another company, and I have decided to pursue this new opportunity.

I submitted my resignation with a notice period of 10 days. However, my employer is not allowing me to resign and has not returned my passport.

Review your employment contract. UAE law mandates a minimum 30-day notice period, but your contract might specify a longer duration (up to 90 days).

Check your contract to know the valid notice period. Employers in the UAE cannot hold employees' passports. Contact MOHRE to file a complaint for violating your rights.

He has no right to reject the resignation as no one is forced to work, and you can file a complaint with the Ministry of Human Resources and Emiratisation to terminate your employment.

You can submit a request for an order on a petition to the judge of urgent matters to obtain your passport as the passport is a personal document and no one but its owner has the right to keep it
