Can a new execution order be submitted to seize assets upon discovering new ones?
Hello,
My execution order in November 2023 to seize the assets of the company manager returned with:
"After reviewing the traffic system, it was found that there was no traffic file + no bank accounts."
Does the court allow me to make another execution order to seize assets and freeze accounts if there are assets since the previous order?
Thank you!
Dear Questioner,
That is not a requirement. People may have assets today and then not have any the next day, or they may not have assets today and have them a year later.
Therefore, you can submit requests each time, especially if you know there are new assets.
Dear Questioner,
Yes, there's a better chance the UAE court will allow you to file another execution order to seize assets and freeze the accounts of the company manager.
The UAE legal system allows for multiple execution orders in such situations.
This provision acknowledges that a debtor might hide or move assets, making them initially difficult to locate.
You may approach the court.
Dear Questioner,
Based on the information provided, a court may allow the filing of a new execution order to seize assets and freeze accounts if there are discoverable assets belonging to the company manager despite the previous order not yielding any traffic files or bank accounts.
This decision would depend on the specific jurisdiction’s rules and procedures regarding execution orders and asset seizure.
It is recommended to consult personally with a legal professional for guidance in this matter.
