Buyer's agency proposes paying us less than agreed in the contract. What to do?
Hello!
As a real estate agency, we recently closed a deal on a plot. The buyer's agency signed an Agreement to Agreement (A2A) with us (agreement with printouts and signatures on the bottom side).
There was a fixed percentage that they should pay us. However, they are now suggesting they will pay us a lower percentage than specified in the contract.
What can we do in this situation? Can we pursue legal action?
Dear Questioner,
Yes, we can send them a strong legal notice and even ask for compensation.
For further clarification, please reach our senior legal consultant Mr. Muhammad Abdullah on WhatsApp.
Dear Questioner,
Thank you for contacting us!
Answering your question, yes it is indeed unlawful and you would have a valid case to pursue. However, we recommend that you do not do so directly as it will be very expensive.
We recommend a cheaper alternative that is by sending a legal notice. This would not only bolster your position if you are forced to file a case but also be more convenient.
We would be willing to accept your request and send the agency a legal notice on your behalf.

Dear Questioner,
Thank you for reaching out to me with your inquiry regarding a dispute arising from a real estate agreement.
I understand the importance of resolving such matters efficiently and am here to provide you with the necessary guidance.
Based on the details you've provided, it appears that there is a discrepancy between the agreed-upon percentage outlined in the A2A agreement and the amount the buyer's agency is now proposing to pay.
In such situations, it is crucial to carefully review the terms of the contract and assess your legal options.
Firstly, I recommend thoroughly examining the A2A agreement to ensure clarity on the terms and conditions agreed upon by both parties.
Pay close attention to any clauses pertaining to payment obligations, variations, or modifications to the agreed-upon terms.
If the agreement clearly stipulates the fixed percentage that the buyer's agency is obligated to pay, and they are refusing to adhere to these terms without valid justification, you may have grounds to pursue legal action for breach of contract.
However, before proceeding with litigation, I advise attempting to resolve the dispute through negotiation or mediation.
Open communication with the buyer's agency to address concerns and explore potential resolutions amicably can often lead to a satisfactory outcome for both parties while avoiding the time and expense of litigation.
Should the dispute remain unresolved through informal means, I am available to discuss your legal options further and provide personalized advice tailored to your specific circumstances.
Please feel free to reach out to me via WhatsApp or phone to schedule a consultation.
Dear Questioner,
Under UAE law, a contract is considered legally binding and both parties are expected to fulfill their obligations as stated in the contract.
If the buyer agency has agreed to pay a certain percentage as stated in the A2A agreement, they are legally obligated to fulfill their promise.
In this situation, you can first try to resolve the issue amicably by discussing it with the buyer agency and reminding them of their contractual obligations.
If they still refuse to pay the agreed-upon percentage, you can file a case with the relevant court or arbitration center.
It is important to note that the UAE has a strict legal system and contracts are taken seriously. Therefore, it is advisable to seek legal advice from a lawyer who specializes in real estate law to guide you through the process and ensure that your rights are protected.
