Can I file a case against a law firm to recover fees paid along with damages?
Good day to you,
The Legal Affairs Department Judge upheld my complaint against a Dubai law firm and banned them from practicing law for 1 month.
Can I now raise a case against them to recover fees paid along with damages? If so, how?
Thank you
Dear C.,
Thanks for your inquiry.
According to Article 880 of the UAE Civil Code, a lawyer is liable for any damages caused to their client as a result of their professional negligence or misconduct.
Therefore, if you have evidence that the law firm's actions caused you financial loss or damages, you may have a case to recover fees paid and seek damages.
To raise a case against the law firm, you will need to file a civil lawsuit in the appropriate court. This can be done with the help of a lawyer or through the assistance of the Legal Affairs Department.
You will need to provide evidence to support your claim, such as documents showing the fees paid and any other relevant information.
It is important to note that the ban on the law firm practicing law for 1 month may not automatically entitle you to recover fees and damages.
You will still need to prove that their actions caused you harm and that you are entitled to compensation.
I recommend seeking advice from us, so we can assist you with filing a civil lawsuit against the law firm.
