Resigned during probation: Do I need to cover employment costs?

Hi,

I just want to ask, I resigned from my company last December 2023 while I was under the probationary period, and they said I need to pay the visa cost, labor card, and medical expenses, totaling around 5k, before they cancel my visa.

Is this correct? By the way, my reason for resigning is that I am returning to my home country.

Dear Questioner,

According to the UAE Labor law, there is no obligation for an employee to pay back the cost of recruitment incurred by the landlord if the employee leaves the job during probation.

He is free to leave the job during probation. And the recruitment expenses will be a question only if the employee wants to join another company. In your case, this is not applicable.

Regarding the above, we would like to inform you that, according to UAE labor law, if an employee resigns during their probationary period, they are not entitled to any end-of-service benefits or compensation.

However, the employer cannot deduct any costs related to the employee's visa or residency from their final settlement.

This includes visa fees, labor card fees, and medical fees. The employer is responsible for these costs and should not pass them on to the employee.

If your employer insists on deducting these fees from your final settlement, you can file a complaint with the Ministry of Human Resources and Emiratization (MOHRE) for further assistance.
