Who is responsible for overstay charges during a labor complaint?
Dear Sir/Madam,
I have worked in the UAE for 2 years and completed my contract. I notified the company a month before my contract expired, expressing my decision not to renew.
When the contract ended, I refused to sign the cancellation paper because the company declined to pay the gratuity and other pending salary. I filed a complaint with the labor authorities.
With 7 days left for my visa to expire, I am unsure if I will be charged for overstay or if it is the responsibility of the company.
Kindly advise!
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
Your employer is generally responsible for visa-related matters. Since you notified your employer of your contract's non-renewal and filed a complaint for unpaid gratuity and pending salary, they should handle your visa cancellation.
If your visa expires before the cancellation is processed, it's typically the employer's responsibility, not yours.
Continue following up with your employer and labor authorities for a timely resolution and consult with us if needed to protect your rights.

Dear Questioner,
You are required to inform MOHRE during the hearing and make a request to bear the cost on the part of the company if it becomes overstayed.
Also, there will be a grace period for your visa even if it expires but this will depend upon your profession.
You need to enquire grace period and make requests before MOHRE.
