A broker suspects non-payment by the company. How to secure commissions?

Real Estate Agency without proper contract & HR system.

I have been working as a certified real estate broker for a real estate agency in Dubai. The company consistently failed to provide a proper contract, and they kept hiring and firing HR managers.

We sign a contract with an HR manager and the next one comes in, as a result, the company manager claims that because the contract was signed by the previous HR, it is no longer valid.

The manager never signs any contract. I have been closing a few deals in the company and now I’m suspecting that they won’t pay since they can come up with another excuse.

How can we legally pursue this matter and secure our pending commissions?

Dear Questioner,

Secure any copies of contracts you signed with any HR managers, even if deemed invalid by the current manager.

Review them and look for specific details like commission rates and termination clauses.

If you suspect that the company is unnecessarily holding the amount, you can escalate the matter to MOHRE.

If you need our assistance to review the same, please share your Whatsapp number.

Dear Questioner,

According to UAE labor law, it is mandatory for all employees to have written employment contracts with their employers.

This contract should clearly state the terms and conditions of employment, including salary, benefits, working hours, and notice period.

If your employer has failed to provide you with a proper contract, they are in violation of the law. In this situation, you can file a complaint with the Ministry of Human Resources and Emiratization (MOHRE).

They have a dedicated labor complaint portal where you can submit your complaint and provide all the necessary details.

MOHRE will then investigate the matter and take necessary action against your employer.

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, it is mandatory for all employees to have written employment contracts with their employers.

This contract should clearly state the terms and conditions of employment, including salary, benefits, working hours, and notice period.

In your case, it seems that your employer has failed to provide you with a proper employment contract. This is a violation of UAE labor law and you have the right to demand a written contract from your employer.

You can start by requesting a written contract from your employer. If they refuse to provide one, you can file a complaint with the Ministry of Human Resources and Emiratization (MOHRE).

MOHRE has the authority to enforce labor laws and can take action against your employer for not providing a written contract.

In addition, if your employer fails to pay your commissions, you can file a complaint with MOHRE or take legal action through the courts.

It is important to keep a record of all your deals and commissions, as well as any communication with your employer regarding payment.

It is also important to note that your employer is required to pay your commissions within a reasonable time frame, as stated in your contract or as per industry standards. If they fail to do so, you can take legal action to recover your unpaid commissions.

In conclusion, it is important to have a written employment contract in order to protect your rights as an employee. If your employer fails to provide one, you can take legal action to enforce your rights and secure them.
