What should my final payments be upon termination after one year?
Dear Questioner,
My employer gave a 30-day notice to everyone, stating that our restaurant is permanently closing. It is located in DMCC, and our contracts are managed by DMCC.
I just need to know, according to labor law, what my final payments should be. I completed one year on December 26, 2023.
Will I be paid only one month's salary, which falls within the 30-day notice period, or will my employer have to pay three months since they are the ones who decided to close down?

Dear Questioner,
You may be entitled to end-of-service gratuity based on your years of service, and a final settlement that includes outstanding salary and accrued leave.
Dear Client,
Thanks for your question! I hope you are doing well. I will assist you in this matter.
If your employer is closing the restaurant and gives you a 30-day notice, they should pay your full salary for that notice period. You may also be entitled to end-of-service benefits based on your 1-year service, calculated as per UAE labor law.

Dear Questioner,
According to recent amendments under UAE Labor law, you will be entitled to receive salary only for the notice period.
The 3-month compensation will be available to you only if the termination falls under Article 47. The above-mentioned reason does not come under the category.
If you need further clarification, we will arrange a legal consultation session for a charge. Share your WhatsApp number if you want to go with the services.
