Offer letter: 30-day notice period, MOL contract: 90 days. Which one is valid?

Hi,

I recently accepted a job offer from a company in Dubai. According to the offer letter, the notice period is 30 days. However, upon joining, I was asked to sign the MOL contract, where the notice period is mentioned as 90 days.

I don't want to sign the offer with a 90-day notice period. I checked with the employer, and they mentioned that this change happened recently.

Kindly advise on the following: Which offer letter is valid in this scenario?

Should I consider filing a legal action against the employer for changing the employment contract terms without informing me?

Dear Questioner,

Normally, MOL will be accepted by the court and MOHRE when a dispute arises. In this situation, the MOL has not yet been signed by you, so the offer letter will be valid enough to file a complaint against the company.

You may submit the complaint to the MOHRE and follow up with the matter. The authority will get back to you in furtherance of your complaint.

Dear Questioner,

Generally, you are required to follow the terms of the employment contract with the company if the terms of the contract are not in conflict with the employment law.

As per UAE Laws, the notice period can be between 30 to 90 days and it is valid to incorporate the notice period as 90 in your contract.

However, if you are not okay with the notice period terms, you can negotiate the same with your employer and also complain to MOHRE.
