Friend owes me money and gave me a blank check. What are my legal options?

Hi,

I had loaned money to a friend a few years ago, and he promised to return it as soon as possible. It has been more than two years, and I have not received the money yet.

I have a blank check that he gave me as security, and it is not dated.

I want to know if there is a legal way to get my money back. If I deposit the check in the bank and it bounces, or if he has closed his bank account, what will the consequences be?

Dear Questioner,

If the cheque bounces due to account closure, you may file a criminal case, followed by a civil execution case.

If the cheque bounces due to insufficient funds, you can only proceed to file a civil execution case.

In the event that there is no balance, you can apply to the enforcement court and go through the enforcement procedures to oblige him to pay the cheque amount.

However, if the account is closed, you can file a complaint at the relevant police station and prosecute him criminally, in addition to demanding the cheque value.

Yes, it is legal to fill in the cheque with that date of your choice and an amount equivalent to the loaned amount and to deposit the cheque as well.

If the cheque returns due to insufficient funds or a closed bank account, then you can take immediate legal action and enforce against this person using the cheque itself.
