س: مرحبًا، إنني أخطط لتأسيس سوق خدمات للموظفين المستقلين. معظم الموظفين المستقلين ليس لديهم ترخيص لممارسة العمل الحر. هل يمكن إبرام عقود بين شركتنا والموظفين المستقلين لجعل وضعهم قانوني للعمل؟ وهل يجب أن تكون هذه العقود ورقية أم إلكترونية؟

Is it legal to work in the UAE without a work permit?

Q: I have been working for an individual as a private accountant for over a year now. My contract says that I'm not an employee but a consultant. I am sponsored on my husband's visa and have a NOC from him to work. However, I'm not set up as a freelancer and my employer hasn't provided me with a labour card or work permit. It has been brought to my attention that I may be working illegally so I would appreciate some legal advice and for someone to look over my contract. If I'm working illegally then I will quit immediately but I need to know my rights and do not want to breach my contract if it is enforceable. I look forward to hearing from someone. Thanks.

س: أريد الحصول على إجابة بشأن السؤال التالي: لدينا شركة منطقة حرة مقرها إمارة دبي، ونريد توظيف ثلاثة أشخاص في مصر (ليس للشركة فرع أو شركة تابعة هناك). ما نوع الاتفاق الذي يمكن إبرامه بين الشركة في دبي والموظف في مصر؟ هل هي اتفاقية عمل تخضع لقانون العمل في دبي؟ هل هي اتفاقية تقديم خدمات بصفته موظف مستقل تخضع لقوانين ولوائح دبي فيما يتعلق بالعقود؟ هل هناك أي ضرائب يجب على الموظف دفعها في مصر إذا قمنا بإبرام أي من الاتفاقيات المذكورة أعلاه؟ إنني أقدر حقًا مساعدتك.

Contract mandates written termination. Access denied suddenly. What to do?

Q: Dear Sir/Madam, I work online with a company based in Dubai. I have a contract with them that stipulates any termination should be communicated in writing and signed by both parties. However, today, they suddenly removed access for us without prior notice.

Hello, I had a case regarding fraud by technical means, and we did a tanazul. It was attested and submitted to the court, but the case still hasn’t been dropped and is now with the public prosecution. What do I do now, as I need to travel urgently?

How can we claim our money back if the cheque we received have bounced for insufficient funds?

We received a cheque which has now bounced. We have tried for over a month and a half now to get a new cheque from the person, and every day he says the next day. We need the money now. We have been to the police station, and they said they can not do anything as the reason the cheque bounced is "Insufficient funds." We have been to Al Barsha - Dubai Courts, and they said there is nothing they can do about it. We are not sure what we can do. We need the money asap to pay our kids' school fees, let alone all the interest we have lost.

Hello I joined my new company on February 26, 2025. Upon joining the new company, I asked HR if it was free to join the company, and she said yes. After working with them for 1 month, I experienced a salary delay, and I had to go to the office to ask why there was a delay in my salary. That is when the HR told me she deducted my whole salary to recover the transfer fee. Now my question is, who is supposed to pay for the transfer fee, the employee or the employer?

Can my old employer sue me for a non-compete clause that's only in the offer letter?

Hi, I was previously working in a company based in DMCC and have now moved to Hamriyah Free Zone. In my DMCC contract, there was no mention of a non-compete, but my offer letter includes one. Now, in my new organization, if my old customers start to contact me for business, am I liable for any legal action from my previous employer?
