How to join a new employer while there is a labor case in court?

Dear Sir/Madam,

I filed a labor complaint, but the company did not pick up the phone when they called twice. We did not discuss the issue mutually, so I was advised to go to court.

I gave a notice period from August 17, 2023 to September 17, 2023. My actual notice period is 3 months, but I did not receive my salary for 4 months.

If I get a job offer letter while the case is in court and want to cancel my visa, will they accept it?

If not, what should I do? Will there be any complications in joining another employer?

You have to serve them the notice period. As the case is still pending with the court, you may request the court to cancel your visa.

I now moved the case to court. My actual notice period is 3 months but because they were not giving me the salary.

I put my notice period from August 17th to September 17, and now the court trial starts on 6 September.

Are there any consequences to this?

Since the default is from the opposite party the judge may consider it.

Now it's 5 months and my salary is pending. If they put the salary now, it'll be for 2 months.

But we already made a memorandum of pending dues and the hearing is on the 6th.

I can say to the court that the salary that came after I filed the case by the date, is there any problem with it?

During the case hearing, if you get a job opportunity, you can submit a request to the court to cancel the work permit.

After the judgment is issued, you can terminate the work permit for an employee with a labor case according to the ruling issued in the labor lawsuit.

There is no problem for you as long as the payment is made after filing the lawsuit.
