Can I claim my labor rights if my employer did not renew my contract?
I am a doctor by profession, and my contract with my company was valid till June 2023.
Last year in September 2022, I canceled my company visa to apply for Golden Visa. After stamping my Golden Visa, my company didn't provide me with a new contract.
My question is can I continue working without a new contract?
Do I have any rights or claim of my unpaid salaries from the court in such a scenario?
Dear Dr. K.
Thank you for contacting Badr Legal Consulting.
We are willing to assist you with that.
First of all, we advise you to sign a new contract with them which saves your rights in terms and conditions.
Regarding your salaries of course you have the full right to claim it and if they refuse you can file a case against the hospital and it will be on your side.
You can share with me the old contract to view it thru my WhatsApp for more understanding and guidance.
Thanks
Mohamed Badr
Yes, definitely you have the right to work under your old contract. It is not required to amend the old contract.
Moreover, your claims for unpaid salaries are valid for 1 year from the day they are due. Visa amendment and contract are not co-related.
If the contract ends, the employee continues to work, and the employer does not object, then the contract is renewed for the same period, and under the same conditions, even if it is not written and signed by both parties, and the employee is entitled to all his labor rights.
However, in the event of a dispute, he must prove that he is still working.
