Why does the court cancel the judgment session and set a hearing for expert?
Dear Sir,
Today (04-05-2022) was my judgment, but now my case status is deferred to pleading and the reason is (To Assign An Expert Next In Turn On The List).
Now my next hearing is on 11 May 2023. Can you tell me why my judgment is canceled and showing a new hearing date?
Referral of the case to the expert may take place at the request of one of the parties, or that the court did not believe or not sure in the documents submitted by both sides.
So it referred it to the expert in order to discuss and clarify the technical points that it was unable to confirm or deny.
If the case is not clear to the judge, and there are technical matters (computational, technological, engineering, medical, for example) and the judge is naturally not an expert except in law, then he refers the case to the technical expert and waits for the expert’s evaluation and opinion.
If, according to the judge's decision, you are required to pay the expert's fees, pay. Otherwise, you will lose your case, most likely.
