Q: Hi, I got a job flying job offer who can apply with low hours from Linkedin and I sent my CV and they called for a Skype interview. It was a 12-min interview. They said for the type rating I have to pay 40% and the company pay 60%. After 6 days, I got a mail by saying I have been selected. They sent me the offer and description. That particular company has a website and mentioned an address too. Its a private jet charter airline. Yesterday I got the offer and said to me to come on 15th February. They said to come with a tourist visa and once I come to Dubai, they will issue a work permit. I just want to know if the company is real and if they offer me a job, they should provide me with a working visa before entering the country, right?

س: مرحبًا، في خطاب عرض العمل الذي وقّعته، ورد أن تكلفة التأشيرة 5000 درهم، يجب على الموظف دفعها إذا ترك العمل قبل انتهاء صلاحية تأشيرته. بعد مرور ستة أشهر، قدمت استقالتي بعد قضاء فترة إشعار مدتها شهرين وفقًا لعقد العمل غير محدد المدة. هل يتعين عليّ دفع 5000 درهم إماراتي باعتبارها غرامة استخراج التأشيرة؟ أخبرني رئيسي في العمل أنه لن يقبل استقالتي حتى أدفع للشركة 5000 درهم. لقد مر 16 يومًا منذ أن رفض استقالتي. إنه يجبرني على دفع 5000 درهم وهدد بحظري إذا لم أدفع. هل يمكنني اللجوء إلى وزارة الموارد البشرية والتوطين؟ إذا قدمت شكوى إلى وزارة الموارد البشرية والتوطين ولم يتم تسوية المشكلة وتم إحالتها إلى المحكمة، هل يتعين عليّ توكيل محام بعد ذلك؟

أقرت دولة الإمارات إصلاحات تشريعية كبيرة أسفرت عن إدخال 40 قانونًا وتعديلًا جديدًا على قانون الشركات والقانون الجنائي وقانون الأحوال الشخصية وغيرها. تهدف هذه التعديلات إلى تطوير الهيكل التشريعي في مختلف القطاعات، وكان أحدثها قانون العمل. نحاول في هذا المقال إلقاء الضوء على التعديلات التي أُدخلت على قانون العمل الجديد وتأثيرها على كلٍ من صاحب العمل والعامل.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

According to this Decree, tentative approval to admit a foreign worker for the purpose of employment in the UAE cannot be granted until an Employment Offer that conforms with the Standard Employment Contract is duly signed by the employee and presented to the Ministry of Labour.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
