هل يمكن حل مشكلة شيك مرتجع في قسم الشرطة؟
س: تلقيت مكالمة من شرطة جبل علي حيث أن عليّ شيك مرتجع بقيمة 60 ألف درهم لبنك الخليج الأول ويريدون أن يروني في الصباح.
أخبرني أحدهم أن هناك سياسة جديدة تسمح بتسوية قضايا الشيكات المرتجعة في قسم الشرطة، وعندما هاتفني الشرطي، طمأنني أنه يمكن تسوية المشكلة هناك في نفس اليوم.
هل هذا صحيح؟ ماذا سيحدث إذا ذهبت إلى قسم الشرطة؟

Issue with rental cheques paid up front
Q: Sir,
I have released 7 post dated cheques for house renting on January 12. January 15 is the date of the 1st cheque which is valued 9k. But on January 15, my bank froze my account because my company terminated me. So I told them to not withdraw the cheque coz I got no money in it and I'm cancelling that property.
When I asked them I need to collect my cheque, they told me I cannot. Not unless I pay them 9000.
Do they have the right to do this? I am in a deep problem as they filed a case against me regarding this. So, I want to know.

كيفية تسوية شيك إيجار مرتجع
س: تم استدعائي للشرطة اليوم، أخبروني أن هناك وكيلًا للمكان الذي قمت باستئجار شقة منه لقضاء أجازة لمدة 4 أشهر قد قدم شكوى بشيكين مرتجعين عن شهري يناير وفبراير.
دفعت المبلغ نقدًا عن شهر يناير في ذلك الوقت ولكني لم أستعد شيكي مطلقًا. وُجد خطأ في توقيع الشيك استوجب دفعه فورًا.
ما هي حقوقي وما الذي يمكن أن أفعله؟

Police case for bounced cheques issued for rent
Q: We rented a business working space at one of the business centres. We used the premises for two months but the service was very bad.
Moreover, our business was a startup, hence it didn't take up. The business centre management had agreed on vacating the place within a week as per our deal. Now, they are not returning our security cheque. We were supposed to pay only AED 4000 for an early exit.
They are arm-twisting us by depositing our monthly cheques along with the security deposit, which of course bounced and they made a police case for which we paid the fine.
They are purely cheating and trying to take the pending rent, but it was agreed that we can vacate.
Please advise what is the next step we can take.

Rental Dispute for the non-payment of rent
Q: The employee of the real estate agency frauded 6-7 tenants from our building and ran away with the rent money.
Now, the real estate lawyer is suing me for not paying the rent and it’s my fault that I gave the cheques to their employees.
What can I do?

تقرير الشرطة أمر بالغ الأهمية قبل إصدار بدل عن شيك مفقود
س: مرحبًا
أعيش في أبو ظبي.
أضاع مالك الوحدة التي أستأجرها شيكًا من الشيكات الإيجارية. لدي إيصال وتوثيق يثبت أنني قد أعطيته الشيكات.
أخبرته بأن يذهب إلى قسم الشرطة ويبلغ عن فقدانه للشيك، ومن ثم يمكنني أن أصدر شيك جديد له، ولكنه قال أن هذا سيستغرق وقتًا طويلًا جدًا.
اقترح علي بأن يسلمني ورقة مكتوب فيها أنه إذا وجدوا الشيك، سوف يرجعونه إليّ، وأعطيهم الشيك الجديد.
برجاء العلم أن هذه شركة تقوم بإدارة أملاك مالك الوحدة المؤجرة.

الإجبار على دفع مبالغ إضافية بعد تسوية شيك إيجار مرتجع
س: السلام عليكم
سيدتي العزيزة،
وجهت لي تهمة إصدار شيك بدون رصيد في أكتوبر 2018 بسبب إخفاقي في دفع الإيجار من خلال الشيك. كان مبلغ الشيك 14000 درهم.
تم استدعائي مرة واحدة فقط من قبل المحكمة ومنحت وقتًا محددًا لدفع المستحقات وإخلاء المنزل. لقد دفعت جميع الإيجار المستحق (حوالي 17000 درهم إماراتي) الأسبوع الماضي.
محامي الوكالة العقارية لا ينهي قضيتي ويجبرني على دفع مبلغ القضية الأولى وبعض الإيجار المستحق عن البقاء مدة زائدة.
قال لي اليوم: لديك يوم واحد فقط لدفع رسوم المحكمة ورسوم القضية، والإيجار المستحق، وإلا فستأتي البلدية غدًا وسيطردونك. هل هذا الأمر ممكن؟
يرجى إرشادي بشأن موعد إغلاق قضيتي. ماذا سيكون حكم البلدية في هذه الحالة؟ وهل هو مرتبط بتجديد الإيجار؟ هل يمكنني تجديد عقد الإيجار الخاص بي أم لا؟
هل يمكنك الرد الآن من فضلك؟
أنا قلق.

Consumer protection and the concept of "cooling period"
Is there a law regarding a "cooling period" on an item purchased?
We had a problem with a company distributing vacuum cleaners in Sharjah, we have returned the item to them as we felt like being pressured to buy without giving us time to think before buying, and their contract states that I have to pay 4,000 Dirhams as a cancellation if I return the item within 3 days.
Is it legal? Where is the 3 day cooling period?

Breach of tenant's privacy
(If) I took a picture of my tenant's living room and posted it on a property website to rent the property, as we've agreed with the tenant that he vacates the property at the end of the year. Then he found out about the advertisement on the property website in the remaining 3 months before the end of the contract (we have posted the advertisement with the picture of the living room) and informed me to remove it from the website. I removed it immediately, but he has printed out the advertisement with his living room pictures.Now he is saying that if I made any issues to him as a tenant or deny his demands or do not renew his contract or increase the rent he will file a case in the police for the privacy breach. Please note that this was not intentional and it was a mistake without knowing the laws about these things.Q: How long does a person have the time to file for a privacy breach until it's considered invalid or it's long overdue or something similar? Kindly advice. Thank you.
