Filing a divorce case against the husband who is not residing in the UAE
Q: As a non-Muslim British citizen with residency in the UAE, can I file for divorce in the UAE from my partner who is a British citizen and resides in the UK? They have never had a work or residency visa in the UAE. How would I start this process and how would they be notified? Can I avoid notifying them? What are the benefits if I were to file a divorce petition in the UAE compared to the UK?

القانون الأفضل لتطبيقه على غير المسلمين هل القانون البريطاني أم الشريعة الإسلامية؟
س: أرغب في طلب الطلاق من زوجتي. كلانا بريطانيين غير مسلمين ونعيش في أبوظبي. لدينا 3 أطفال (12 و 9 و 8 سنوات). أعلم أنه سيتم منحنا حضانة مشتركة بعد الطلاق ولكني أتمنى أن يعيش الأطفال معي بشكل أساسي في منزل عائلتنا. إذا كان منزلهم الرئيسي معي، فهل سأظل ملزمًا بدفع النفقة لزوجتي، حتى لو كانت تعمل؟ ما هي النسبة المئوية من راتبي الشهري البالغ 35,000 درهم الذي يجب أن أتوقع دفعه بشكل معقول؟ إلى متى ستستمر دفعات النفقة؟ أحاول فقط أن أفهم أنه إذا كنت مقدم الرعاية الأساسي للأطفال، وأدفع رسومهم المدرسية، وأغطي تكاليف معيشتهم (إذا كانوا يعيشون معي)، فما الذي يحق لزوجتي الحصول عليه في التسوية كدفعة شهرية؟

Q: Can a non-Muslim wife of a Muslim husband file a divorce as per the new non-Muslim personal status law? Or she must file for divorce only as per Sharia law?

أصدر صاحب السمو الشيخ خليفة بن زايد آل نهيان، رئيس دولة الإمارات العربية المتحدة وحاكم أبوظبي، مرسومًا مدنيًا جديدًا للأحوال الشخصية في إمارة أبوظبي. يُطبَّق مرسوم الأحوال الشخصية هذا على الأجانب غير المسلمين المقيمين في أبوظبي في مسائل الزواج والطلاق والوصية والميراث وحضانة الأطفال.

Federal Law No. (28) of 2005 On Personal Status
UAE Personal Status Law (also known as Personal Affairs Law) governs marriage, divorce, inheritance and other personal affairs in the United Arab Emirates. The law equally applies to citizens of the UAE and non-citizens unless one of them asks for the application of his home country law.
