يجب عليك أن تنبه المحكمة الموقرة الى ذلك، وأن تقوم بالاعتراض على تقرير الخبير المحترم، وتحديداً على أنه لم يقم بالمهمة الموكلة اليه على أكمل وجه، ولم يلتفت الى القرض الأول كما ذكرت. وكان يجب عليه أن يقوم بحساب الفائدة بناءاً على النسبة المذكورة في العقد الموقع بينك وبين شركة التمويل وليس ما هو ممهور بخط اليد، كما أنه وكيف للخبير أن يغفل أن قيمة شيك الضمان أقل من المبلغ المطالب به مضافاً اليه الفوائد؟؟!!! لا تتردد بالتواصل معنا عبر بريدنا الإلكتروني ms@elnaggarlegal.com طاب يومكم

Is there a legal way to avoid imprisonment if the court passed a sentence upon me?

Q: Hi , I left UAE during the financial crisis 2009 because I got laid back by my employer and I could not pay back my bank loan. The bank collection agents contacted me few times but I couldn't reach an agreement with them as I am facing financial difficulties as a single parent for 2 kids currently not working. l want to go back to UAE for a job offer. A friend checked for me with Immigration and Court. They found that there is a judgement in absentia of 6 months under my name and case filed requesting the amount of the loan plus the interest which I can not afford paying a single portion of it. Is there a legal solution to sort this out due to 9 years passed since I left the UAE? So I can get a job offer and support my kids and if my financial situation improves in the future I will try to settle the loan. This 6-month absentia imprisonment was issued 6 months ago.

كيف أقاضي بنكًا اتهمني ظلمًا بناءًا على وثائق مزورة؟

س: قام البنك برفع دعوى ضدي، وعندما قابلت الفريق القانوني للبنك، وجدت أن الوثائق مزورة وتم طلب تحصيل القرض. تم احتجازي في القسم لمدة يوم وعانيت فيه كثيرًا، ثم قام البنك بسحب الدعوى. كيف لي أن أطلب تفسيرًا وتعويضًا من البنك؟ هل يمكنني مقاضاة البنك؟ حالتي المادية متعسرة الآن وأريد أن أدفع رسوم المحامي بعد الحصول على التعويض، كما أن لديّ دليلًا على أن الوثائق مزورة.

الضمانات التي تحصل عليها شركة التمويل مقابل إعطاء قرض

س: حصلت على قرض شخصي وكريدت كارد من مؤسسة للتمويل بإجمالي ٥٠ ألف وتعثرت لفترة والآن يطالبونني بدفع مبلغ ٢٠٠ ألف درهم بالفوائد وكنت أعطيتهم شيك بقيمة ٤٢ ألف وقتها. سؤالي: هل يوجد سند لأمر داخل عقد القرض (الأبليكيشن) الخاص بالشركة التي وقعت معها في البداية؟ أم لا يملكون ضمانًا آخر يُمكِّنهم من مقاضاتي به سوى الشيك الذي أعطيته لهم فقط؟ مع جزيل الشكر!

رفع دعوى لندب خبير مصرفي لحساب المديونية على حقيقتها

س: عملت تسوية مع أحد البنوك بالإمارات بخصوص كريدت كارد. السداد بفائدة عالية على 3 سنوات. المشكلة أني أسدد بعد معاد الاستحقاق والبنك يضيف فائدة إضافية وغرامة تأخير شهريًا. المبلغ المتبقي مرتفع وباقي 6 أشهر بسب فوائد التأخير وتنتهي مدة الـ3 سنوات. هل يمكن رفع دعوى لندب خبير حسابي لمعرفة المبالغ التي سددتها خلال 3 سنوات ومعرفة المتبقي؟

How can I renew my Ejari if the landlord hasn’t signed the new contract?

Hi, I have been here for 3 years now and paid the increased amount (as per the agreement) for the 4th year. However, the landlord did not send me back the signed contract, although I have both made the payment for the full year via bank transfer and sent my signed contract to him. I need to renew my Ejari; however, how can I do it without the landlord's signature? I have all the previous contracts signed by both parties, along with the Ejari for those contracts.
