Q: Dear Sir/Ma'am, I have a labour case in Dubai Court and won the case. I have also done filing the execution. I was informed that the court already put a block on my employer's name. Q: My salary labour case has been going on for 7 months now. After the 1st judgement, the owner appealed because of which I had to wait again and go for the 2nd judgement. Question1: Can he appeal 2nd time again? Question2: I have a Job Offer. I want to cancel this visa of my previous employer. What should I do as enough time has already been wasted?  Help appreciated!

س: لقد منحت أحد الأشخاص 250,000 درهم باعتباره قرض نقدي. حصلت على إقرار بالمديونية موقّع بواسطة شاهدين. في وقتٍ لاحق، سلمني المقترض شيكات بقيمة 100,000 درهم إماراتي وأعطاني خطابًا يُفيد بأن هذه دفعة جزئية من إجمالي قيمة القرض. عندما تم ارتجاع الشيكات، رفعت قضية تجارية مقابل 100,000 درهم على أساس الشيكات، وربحتها، وبدأت في قضية التنفيذ. ثم رفعت قضية تجارية جديدة مقابل المبلغ المتبقي بقيمة 150,000 درهم على أساس الإقرار بالمديونية مقابل 250,000 درهم. وربحت في الدرجة الأولى والاستئناف. ولكن خسرت أمام محكمة النقض الموقرة. حيث قضت محكمة النقض بأن هذه القضية الجديدة التي تبلغ قيمتها 150 ألف درهم هي تكرار للقضية القديمة البالغة 100 ألف درهم ولا ينبغي الحكم فيها مرة أخرى. حجية الأمر المقضي به. ما هي الخيارات المتاحة أمامي؟ هل فقدت حقي في استرداد المبلغ المتبقي بقيمة 150,000 درهم أم فقدت الحق في متابعة الأمر بشكل قانوني فحسب؟ ما هي الخطوات التي يجب عليّ اتحاذها لاسترداد المبلغ المتبقي وقدره 150,000 درهم؟ شكرًا لك.

Q: Is it possible to register a Cassation lawsuit against a verdict of "Appeal to Commercial Execution"? I registered an "Appeal to Commercial Execution" lawsuit. I am not happy with the verdict since I feel it has an error of interpretation and implementation of the law. What can I do? Is it possible to register a Cassation lawsuit? Is it possible to meet the Honorable Appeal judge? Is there any other way to contest the verdict of an "Appeal to Commercial Execution"?

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

The law promulgates UAE Civil Procedures Code (Civil Procedure Law) which governs civil procedures in the United Arab Emirates, including the prosecution before the courts, litigation and execution.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
