What to do if you received judgment in absentia of fine and jail in a case after obtaining Tanazul?

What does “Dispositioned” mean in a UAE - Abu Dhabi case?

We have a Tanazul, but the case status is showing Judgment Done, with a 15,000 AED fine and 6 months' prison reserved. Does this mean he will go to prison?

We missed one hearing on 28/08/2025. After that, we thought we had Tanazul, so we went to collect the passport, as I am the surety for my father. However, at the police station, they stopped him, saying he had a Tameem.

Please help and advise what will happen. We have Tanazul, but the judgment is already done, and no appeal has been filed yet.

The status shows Judgment Done on 28/08/2025. We missed the hearing that day, the prison sentence of 6 months is reserved, and a 15,000 AED fine has been issued.

What should we do?

Dear Questioner,

Thank you for your message. I understand how concerning this is for you and your family.

The status “judgment done/dispositioned” means the court has already issued a final judgment of AED 15,000 fine and a six-month prison sentence.

A tanazul (withdrawal of the complaint) does not automatically cancel a criminal judgment once it has been issued. The Public Prosecutor or the execution judge must first accept the tanazul and issue a new order.

Because the 28 August hearing was missed, the judgment became final, and the right to appeal has likely expired. The “tameem” hold you encountered is a police order to enforce that judgment, which is why your father was stopped.

Next steps we can assist you to:

- Obtain the certified judgment and execution file from the Abu Dhabi court.

- Submit the signed tanazul with a request to the Public Prosecutor/execution judge to cancel or reduce the sentence.

- Arrange immediate payment of the AED 15,000 fine if required to lift the tameem and avoid imprisonment.

Please share the case number, a copy of the judgment (if available), and the original tanazul so we can act quickly on your behalf.

Kind regards,

Mohammed Salah

Dear questioner

As it is a little complicated matter it is adviced to hire lawyer for your assistance and strategically plan the case, since the judgment was issued in absentia, your father (through his lawyer) has the right to file an objection to the judgment within a specific time frame, usually within 7-15 days from the date of his notification (which is now that he's been stopped).

This appeal essentially asks the court to reopen the case, and this is where the "tanazul" will be the key piece of evidence.

If you need our assistance in your matter, kindly share your WhatsApp number.

It is not sufficient to believe there is an "exemption" unless it is presented to the court or officially recorded.

The father's arrest is a natural legal reason following the issuance of a prison sentence in absentia.

You still have the opportunity to have the judgment in absentia overturned and a retrial ordered.

If you do not act within 7 days of the arrest, the judgment becomes final and enforceable.

Greetings,

Based on the details you shared, it seems that despite having a tanazul (waiver), the court has already issued a judgment of a fine and a reserved prison sentence.

Missing the hearing may have caused the court to proceed in your absence. This is why the status shows a judgment and why the police are still holding your father’s passport under tameem.

The situation requires urgent legal review to determine whether an appeal, objection, or special request can be filed to suspend or cancel the prison sentence.

We recommend booking a consultation with Future Vision for Advocacy and Legal Consultancy so we can review the case documents and take immediate action on your behalf.

Thank you for contacting us via Legal Advice Middle East.

What you describe means the Abu Dhabi court has already issued its judgment on 28/08/2025: AED 15,000 fine plus a prison sentence of 6 months “reserved.”

The word Dispositioned in the system shows the case has reached the judgment stage, not that it is pending.

Because you missed the hearing, the ruling was likely issued *in absentia*. That is why the police enforced the *tameem* (circulation order) when you tried to collect the passport.

Even though you obtained a tanazul (waiver from the complainant), it must be filed before the court to have legal effect.

Once a judgment is entered, the waiver does not automatically cancel the sentence. The proper step is to file either:

1. An appeal (if the deadline has not expired), attaching the waiver to request cancellation or reduction of the custodial sentence.

2. An application for reconsideration/petition to set aside the judgment if the appeal window has closed, using the waiver as new evidence.

Until the court issues a new order, the judgment (fine plus prison) remains enforceable, which is why your father is still stopped under tameem.

The most urgent step now is to instruct a lawyer in Abu Dhabi to file the waiver officially and request suspension of execution of the prison sentence while the application is reviewed.

This response is provided by RASHID ALKAITOOB ADVOCATES & LEGAL CONSULTANTS based solely on the information you’ve provided and does not constitute a final legal opinion.

A binding legal assessment requires reviewing the judgment, the waiver document, and the case file. We would be grateful for your positive review once we assist you.
