The company paid our salaries after we stopped work and filed a complaint in MOHRE. Do we still need to report to work?

What should we do if, after filing a complaint with MOHRE, the company has already paid all our salaries?

Do we still need to report to work?

Should we submit a resignation to avoid being tagged as absconded, or what would be the best solution?

Because, for us as employees, we don’t want to go back to work after what happened.

Send a notice to the employer that you do not want to continue the employment relationship.

You should submit a formal resignation to avoid being considered "absconding", and this is the best solution.

Thank you for contacting us via Legal Advice Middle East.

Your question raises two overlapping issues: the MOHRE complaint and the continuation of the employment relationship.

We previously acted in a nearly identical case where the company paid the withheld salaries after the employee filed a complaint.

The payment alone does not automatically terminate the employment contract, which means you are still legally bound to report to work unless you formally end the relationship.

If you simply stop going, the employer may report you as absconding.

There are a few possible legal routes.

If you no longer wish to continue, the safest solution is to submit a written resignation through MOHRE or directly to the employer, while keeping proof of submission.

This way, you protect yourself against any false absconding claim.

Another option is to request through MOHRE to terminate the contract by mutual agreement, which often happens after disputes are settled.

The key is to avoid silence, since without formal closure, the employer retains leverage.

The best course depends on the type of contract you signed and whether you seek a clean cancellation for a new job or to exit the UAE.

We can help you prepare the resignation or termination request in the correct format and ensure MOHRE records reflect the true end of service.

This response is provided by RASHID ALKAITOOB ADVOCATES & LEGAL CONSULTANTS based solely on the information you’ve shared, and it does not constitute a final legal opinion.

A binding legal assessment requires reviewing your contract and the MOHRE file. We would be grateful for your positive review once we assist you.

If your employer has cleared all pending salaries after you filed the complaint with MOHRE, the situation depends on your contract status and your intentions:

Reporting to work: If you do not report back and have not formally ended your contract, the company could attempt to mark you as absconded.

Resignation option: To protect yourself, the safest way is to submit a written resignation (with notice period as per your contract, usually 30 days unless waived by the employer).

This closes the door for the company to file absconding.

Settlement with MOHRE: Since the case is already with MOHRE, you can inform MOHRE during the hearing/closure that you do not wish to continue employment and request cancellation of your visa after resignation.

Best solution: The cleanest approach is either:

Negotiate with the company before MOHRE to mutually terminate the contract and cancel your visa, or

File your resignation formally, attend MOHRE, and ensure your end-of-service dues and visa cancellation are processed.

This way, you secure your record, avoid absconding, and ensure no future immigration or labour restrictions.

I can guide you in drafting the resignation or represent you at MOHRE to negotiate a safe and final exit with your full entitlements.

You may reach out to me directly on WhatsApp or phone so we can discuss your situation in detail and work out the best exit strategy for you.

Dear Questioner,

Thank you for your inquiry. Here is the guidance based on the UAE labor law:

Salaries Paid After Filing Complaint

If the company has already paid all outstanding salaries, your financial dues are considered settled. However, your employment contract remains valid until officially terminated.

Returning to Work

Legally, unless your resignation is accepted or your contract is terminated, you are still considered an employee.

Not attending work without proper notification could be considered absconding, which can have legal consequences.

Submitting a Resignation

The safest approach is to submit a formal resignation through MOHRE (via the Wage Protection System), ensuring that your resignation is officially recorded.

This protects you from being tagged as absconded and allows you to leave the company without legal complications.

Alternative

You can also request mutual termination with the employer. If they agree, MOHRE can formalize the termination, and your employment will end cleanly.

Recommendation:

To avoid any negative record, submit your resignation or request mutual termination through MOHRE. Avoid simply not attending work, as this could impact future visa or employment opportunities in the UAE.

If you want, we can assist in preparing the resignation or mutual termination request to MOHRE to ensure it’s properly documented and your rights are protected.

Best regards,

Mohammed Salah

Dear Client,

Thank you for your inquiry.

Based on the UAE Labour Law (Federal Decree-Law No. 33 of 2021), even if your employer has settled outstanding salaries after a MOHRE complaint, you are still considered legally employed until your contract is formally terminated.

To avoid being reported as absconding— which can lead to serious consequences such as labor bans— we strongly advise submitting a formal resignation.

You may resign with notice (Article 43), or without notice (Article 45) if there is evidence of serious legal violations, such as delayed salary or unsafe working conditions.

Until your resignation is processed, you are required to report to work. We’re here to assist you with drafting a compliant resignation letter and guiding you through the MOHRE process to ensure full protection of your legal rights.

Warm regards,

If the company pays all back wages after you file a complaint with the Ministry of Human Resources and Emiratisation, you are still required to report to work unless a formal resignation is submitted or either party takes action to terminate the contract.

Do not submit your resignation to avoid being labeled as absconding; the company has corrected the main error in paying wages.

The best solution is to follow up on your cases with the Ministry of Human Resources and Emiratisation to ensure there are no further violations and to contact the company to resolve any unresolved disputes.

The safest route is to either:

- Submit a resignation officially through MOHRE, or

- Agree on a mutual termination with the employer.

Hello,

if your complaint with MOHRE has resulted in your company paying all outstanding salaries, you are still generally required to report to work unless your contract is formally terminated or you have resigned.

Not reporting to work without resignation may lead to your status being considered as absconding.

To avoid any negative implications like being tagged as absconded, it is advisable to submit a formal resignation if you do not wish to continue working. This will protect your employment record and allow a clean exit.

If you want, I can assist you with drafting a proper resignation letter or guide you through the exit procedures.
