I already did complaint against my salary and gratuity not paid from my previous employer
I already made a complaint against my previous employer for not paying my salary and gratuity. Now I have the final judgment from the court.
They didn’t get enough documents from me, that’s why my case was finalised. Only a smaller amount is granted to me.
In this situation, can I do anything to get my full amount?
If the labour court has already issued a final judgment, you cannot re-file the same claim unless you present new evidence or documents that were not considered earlier. Your options are:
- Cassation appeal (only if deadlines allow, and if there was a clear error in law or procedure).
- Fresh claim only if you obtain strong new evidence (such as payslips, bank transfers, or employment correspondence proving higher dues).
Otherwise, you will need to enforce the current judgment to collect what the court awarded.
Would you like me to review your judgment and documents to see if a cassation or new filing is still possible?
