How can I remove or reduce my overstay fines to remove my arrest warrant and cancel my visa?

I am seeking your urgent legal assistance regarding my current situation in the UAE.

I am a former Branch Manager whose residence visa expired on 23 May 2025, and I have exceeded the grace period of three months.

Unfortunately, I was unable to cancel my visa due to an arrest warrant arising from non-payment issues linked to the company I was previously employed with.

On 16 August 2025, I was arrested and attended the Prosecutor’s hearing on 17 August 2025. I was released with an ankle tracker under the condition that partial payment must be made by 16 September 2025.

At present, I am no longer employed by the Company. My labour card has been cancelled.

I have not received my final settlement or end-of-service benefits.

I am a single mother sponsoring a child, and urgently need to regularize my visa status to be able to work again.

I want your guidance and representation on the following:

How to resolve or remove the arrest warrant/tracker condition/my name from this case?

My main point now is not to be attached to the company, and the partial amount is huge, amounting to more than a million dirham from the contract between my company and the other party.

4 Sep 2025, 06:27

Thank you for clarifying your main concern.

Your priority is to dissociate yourself from the company and ensure that the obligations arising from the company’s contract do not affect you personally.

Given that the partial amount involves more than a million dirhams under the company’s contract, it is crucial to:

Establish your personal liability (or lack thereof): We can review the arrest warrant, the tracker condition, and the underlying case documents to determine whether you are personally responsible for the company’s obligations or if your liability is limited to what was due to you under UAE law.

Negotiate with the Authorities: Based on the above review, we can approach the Public Prosecution and relevant authorities to clarify that the dispute is company-related and not personal, seeking removal of the tracker and arrest warrant against you personally.

Legal Representation: We can represent you in all communications and proceedings to ensure that the case reflects your status as a former employee, not as a guarantor or party responsible for the company’s contracts.

Next Steps for Visa Regularization: Once your personal liability is addressed, we can proceed to safely regularize your visa and allow you to work legally again.

Please advise on the needful so that I will not be associated with the former company.

Through legal representation, apply to the Public Prosecutor to modify or lift the tracker and negotiate a payment plan.

The tracker is part of your bail terms. It will only be lifted once either:

You make the required partial payment, or

Your lawyer applies to the prosecutor/court to replace the tracker with another form of guarantee, such as a payment plan, a guarantor’s passport, or a bank guarantee.

Without resolving this, immigration will not regularize your visa status.

Immediately file a labour case for your EOSB and settlement dues.

Once the criminal matter is either settled or a payment arrangement is in place, we can then regularize your visa and sponsorship for your child.

This is a sensitive situation and needs careful handling before the next payment deadline. I can represent you in both the prosecution case and the labour claim.

[----] But I am not the owner of the company, and I just don't want to be associated with the company

The labour claim is fine. I just need to remove my attachment to the inactive company.

Dear Client,

Thank you for sharing the details of your situation. Based on the information provided, here is our advice:

Your arrest and ankle tracker are linked to unpaid obligations from your former employer. Legal intervention may allow removal or modification of the tracker.

Your expired visa cannot be regularized until the legal case and financial obligations are addressed. Options may include family sponsorship, investor visa, or new employment with legal assistance.

You are entitled to your final settlement and end-of-service benefits, which can be claimed through MOHRE or the courts.

Recommended next steps:

- Engage legal representation immediately to address the tracker and protect your rights.

- Document your financial status and any evidence related to the employer obligations.

- Pursue your end-of-service claim to recover unpaid salary and benefits.

Once legal matters are resolved, proceed to regularize your visa.

Please contact us urgently via email or phone to schedule a consultation and begin representation. Time is critical.

Kind regards,

Thank you for contacting us via Legal Advice Middle East.

Your situation involves three urgent layers: the criminal enforcement linked to the unpaid company obligations, your expired visa status, and your rights to claim your end-of-service dues.

We have successfully represented a client in a very similar case who was placed under an ankle tracker due to corporate liability disputes.

Through partial settlement negotiations with the creditor and simultaneous applications before the court, we secured the removal of the tracker and enabled the client to regularize their residency.

There are generally three possible directions here. First, negotiate or make an official payment plan through the court to demonstrate compliance with the prosecutor’s condition, which often allows the warrant and tracker to be lifted.

Second, petition for release from the tracker based on humanitarian grounds as a single mother, especially once a credible settlement is in progress.

Third, pursue your claim for unpaid benefits against your former employer to offset part of the liability.

The silent risk is delaying any of these steps, as the court may escalate to detention if the partial payment deadline is missed.

The smarter approach is to combine both defense and settlement strategy: act quickly to show the court evidence of willingness to pay, while filing a parallel labor claim to secure your rightful entitlements.

This dual action strengthens your legal standing and opens the door to restoring your visa status.

To advise you precisely, we would need copies of the prosecutor’s order, the company case details, and your employment contract.

Our multilingual consultants in Arabic, English, Russian, Hindi, and Chinese are available to represent you immediately before the court and authorities to regularize your status.

But I am not the owner of the company, and certainly I will not be able to go for the settlement at AED 5.3 million.

I would like to look for dismissal from the obligation, which is not supposed to be under my name.
