The property developer wants to add huge charges on me for modifications after the NOC. What to do?

Hello,

In short, I have an issue with [-----] Properties as an owner in [-----].

They want to impose on me fines and huge additional charges (over 40,000 AED) for modifications that were executed before I purchased the property, and after they have provided a NOC.

They have also been absent for over 2 months and have not replied to my questions.

I would like to know what my options are, what the risks are if I ignore their demand, and any other relevant information on the topic.

Thank you in advance!

Dear Client,

Thank you for sharing your concerns regarding the fines and charges imposed by [----] Properties for modifications made before your ownership and after receiving the NOC.

Given the significant amount involved and their lack of communication, it is important to address this with a clear legal strategy.

You have the right to challenge unjustified fines, especially when backed by proper documentation such as the NOC and proof of purchase timing.

Ignoring the demand risks escalation to Dubai Land Department dispute resolution centers or court proceedings, which could result in additional costs or enforcement actions.

My legal services cover a thorough review of your documents, negotiation with [-----] Properties on your behalf, and representation in mediation or formal dispute resolution with the Dubai Land Department and Real Estate Regulatory Agency (RERA).

I aim to protect your ownership rights and achieve a fair outcome promptly.

Please feel free to contact me to schedule a consultation so we can discuss your case details and outline the best way forward.

Best regards,

Abdul Wahied

Dear Questioner,

Thank you for reaching out regarding your concerns with [----] Properties in [-----].

From your description, it appears that the fines and additional charges they are seeking relate to modifications made prior to your ownership and after the NOC was issued. Additionally, their lack of response for over two months is noted.

We can assist you by reviewing your case in detail, including:

- The validity of the fines and charges imposed.

- Your rights as a property owner under UAE law.

- Possible legal strategies to dispute or negotiate these charges.

- Risks associated with ignoring their demand and potential remedies to protect your interests.

If you wish to proceed, we can arrange a legal consultation to assess your documentation, draft formal responses, and guide you through the next steps to protect your rights.

Please let me know a suitable time to schedule this consultation.

Kind regards,

Mohammad Salah

Dear,

Thank you for reaching out regarding the fines imposed by [----] Properties.

Based on the information provided:

You may formally dispute the fines by sending a written notice along with supporting documents, including the NOC and purchase agreement.

Engaging a UAE property lawyer is recommended to protect your rights and communicate with [----] on your behalf.

You may also file a complaint with the Dubai Land Department (DLD) or RERA if [----] remains unresponsive.

Ignoring the demand carries risks of escalation, but if you have proof that the modifications were approved before purchase, your position is strong.

If you wish to be represented, please contact us via email or by phone.

We can assist in drafting a formal letter to [----] disputing the charges and requesting withdrawal, to safeguard your interests.

Kind regards,

Dear Inquirer,

Thank you for reaching out. In cases involving property developers such as [----], it is important to carefully review the sales agreement, the NOC, and the basis for the claimed fines.

Your liability may depend on whether these modifications were officially recorded before your ownership. Ignoring their demands could carry legal or financial risks, so it is advisable to address the matter formally.

To provide you with accurate guidance and protect your interests, we recommend booking a consultation with Future Vision for Advocacy and Legal Consultancy, or authorizing us to represent you directly in this matter.

To resolve the issue, I can file a lawsuit against the real estate broker or seller, as imposing fees on modifications made before the purchase and after the NOC is submitted violates real estate laws.

Ignoring the request risks legal action against the seller or broker, which could negatively impact your reputation in the real estate market.

Thank you for contacting us via Legal Advice Middle East.

Your case is not uncommon with developers, and we have successfully represented owners in identical disputes with [----], where claims for penalties and charges were raised after purchase.

The court recognized that when a No Objection Certificate was issued and the buyer purchased in good faith, the developer could not later impose retroactive fines for works done by a previous owner.

There are several directions you can take. One option is to formally contest the charges by sending a legal notice demanding justification and proof that you, as the new owner, are responsible.

Another is to file a complaint with the competent authority if the developer continues to ignore your communications.

The hidden risk in ignoring the demand is that [----] could attempt to withhold services, delay NOCs for future sales, or open a claim, though such actions are often challengeable.

The most strategic route is to document your position now, including the original NOC and your purchase date, to show that liability for modifications does not attach to you.

To give you precise guidance, we would need to review your title deed, sale documents, and the NOC provided.

Our multilingual consultants (Arabic, English, Russian, Hindi, and Chinese) can represent you in negotiations with [----] and in any proceedings to have these charges removed.
