Trust
A relationship created at the direction of an individual, in which one or more persons hold the individual’s property subject to certain duties to use and protect it for the benefit of others. Individuals may control the distribution of their property during their lifetime or after their death through the use of a trust. A trust may be created for the financial benefit of the person creating the trust, a surviving spouse or minor children, or for charitable purposes. Show cause order
A court order that requires one or more of the parties to a case to justify, explain or prove something to the court. Court’s commonly use orders to show cause when the judge needs more information before deciding whether or not to issue an order requested by one of the parties. For example, if a party requests that the court find another party in contempt of court of an existing order, the judge will typically issue an ‘Order to Show Cause Re Contempt’ to the party accused of being in contempt of court. Lis pendens
Latin for ‘suit pending’, it is a written notice that a lawsuit has been filed concerning real estate, involving either the title to the property or a claimed ownership interest in it. The notice is usually filed in the county land records office. Recording a lis pendens against a piece of property alerts a potential purchaser or lender that the property’s title is in question, which makes the property less attractive to a buyer or a lender.
