Q: Dear Sir/Madam, I am currently on a company visa, which began last October 2023. However, with the recent management change, I am uncomfortable with my workload. I am handling the responsibilities of three positions but receiving a low salary. Moreover, 80% of my colleagues, including management, are Russian speakers, while I am not. Many of my colleagues have minimal workloads but higher salaries. I feel exploited, discriminated against, and undervalued. Resigned during probation: Do I need to cover employment costs?
Q: Hi, I just want to ask, I resigned from my company last December 2023 while I was under the probationary period, and they said I need to pay the visa cost, labor card, and medical expenses, totaling around 5k, before they cancel my visa. Despite contract end, employer demands work till labor card expires
Q: Hi, good day! The contract I signed in the Philippines on February 9, 2022, was set to expire by February 9, 2024. I decided not to renew it and discussed this personally with my employer, who agreed. However, she now informs me that I still need to work until March 23, 2024, as the labor card expires on that day. I entered the UAE on March 23, 2022, and the contract was signed while I was still in the Philippines. Despite this, I have already decided not to continue working for personal reasons. Can I lift a travel ban and return to the UAE if I left with visa overstay issues?
Q: Sir. I have uae ban in year 2008. The reason is passport cheating issues. No visa for 8 months stay in the UAE. Last outpass through exit in the UAE. After 1 year, again in 2009 I applied for a visit visa but no chance to visit in Dubai because I have ban in the UAE. After 14 years, last 4 month back again I tried but there no chance. We signed an MOU and it expired before the developer granted NOC. Can we refuse to extend?
Q: We signed an MOU in December`23 and it expired on the 9th of Feb. The buyer has got the manager`s cheque ready but there is a long delay from the developer`s end in issuing the NOC. Do I still need to vacate the property despite clearing dues?
Q: Hi, I received a notification from Dubai courts regarding non-payment of rent on 26/01/2024. It stated that all pending rent must be paid, and the property must be vacated within 30 days. All rent has now been paid up until the tenancy contract end date on 04/03/2025. Do I still need to vacate the property? The landlord is suggesting I renew the contract but is requesting a 25% increase in the annual rent. Can anyone advise if my only option is to vacate the premises or agree to the 25% increase? I defaulted on a personal loan and the finance company filed a civil case with a much higher amount
Q: Hi, I have received a message from a finance company legal team stating that my file has been sent to start filing a civil case for my personal loan for which I defaulted on its payments. Total loan: AED 98,000 Tenure: 120 months Interest rate: 39.99 Amount Paid: 36,740 No. of Months Pending: 109 pending Amount Pending: 364,060 Principal Amount Pending: 94,547.65 During my settlement discussions, I requested to take into consideration the amount that has been paid towards my loan: 36,740 AED, however, this request has been rejected, and it has been proposed to pay AED 80,000 in one shot. I also requested multiple times to receive the statement of all payments that I made. Requests have been rejected and I have submitted a complaint to the Central Bank which is still under investigation How can I better negotiate a settlement that is more reasonable in order to avoid a civil case? Can I cancel the contract with my tenant before it started for not fulfilling his obligations?
Q: Hello, I need your help with advice. I own a property and recently signed a contract with a new tenant who is supposed to move by March 1st. But I haven’t received the deposit or first payment and when I asked about the payment, he said that he is out of the country till mid of March and will check how to sort this issue. Will the contract be void if he didn’t pay the deposit yet? Once I signed it, I had to go through the rental dispute center against him even though our contract hadn’t even started yet. How and when do I get paid after getting a labor judgement in my favor?
Q: Dear respectable Legal experts, I have a question: I filed a case against my employer for my salary, gratuity, and annual leave and it took 6 months until the case judgment came in my favor. During these months, I could not get a job due to the legal case as other employers were reluctant to offer me a job. Please advise as per the UAE Labor Law. Do I have the right to claim any housing allowance or basic salary any compensation? As you know, it is very difficult to survive without a job in Dubai and if you are also living with your family and kids going to school. Can the eviction happen despite the reconsideration case by the tenant?
Q: Dear Sir/Madam, We won an eviction case and appeal against a tenant. We filed for execution, and the tenant has filed a reconsideration case. The eviction date is 12th Feb, and the hearing date for the reconsideration case is 7th Mar. 1) Can the eviction happen on 12th Feb despite the reconsideration case? 2) Is our final right of eviction of the tenant based on the judgment of the Reconsideration case? If so, can we request an earlier hearing date for it? The tenant fraudulently kept us away from the court proceedings in an offer to deposit case he filed before the eviction case and got a favorable judgment. His basis is that he already has a judgment for an extension of Ejari which precedes the eviction judgment (i.e., an argument of Res Judicata). The court recognizes our reply that the argument doesn`t apply as the cause of action of both judgments is different. The tenant has already extended his stay in the property by 8 months this year (post end date of Ejari) and has not paid rent either. We served a 12-month legal vacating notice for sale as per law. I got a judgment against a cryptocurrency company that failed pay me and closed. What to do?
Q: I give an investment to a Pakistani individual for trading opportunities in cryptocurrency. He gave me three cheques as security against my investment. He used to give me profits every month. After 4 months, he failed to give me a profit by saying all investments were liquidated and lost. I opened a cheque execution case against him and all three cheques (100k + 12k + 29K AED) got bounced due to insufficient funds. During this stage, the person managed to leave UAE and flee to his home country ( Pakistan). It is more than 4 months after my execution case yet I didn`t receive any money from the court. I hired a contractor for works in my villa and failed in performing obligations. What can I do?
Q: Hi, I got an approved contractor in my villa for bathroom and kitchen work but he really failed to bring what he promised. The finishing is really really bad. Parts of the ceiling are falling down every few days. The kitchen is in a very bad shape, they used silicon to attach tiles instead of glue. Some doors fell off after a few times using, and some doors can’t even be opened because another door is blocking their way. The toilets are a total mess, some tiles are broken, the door frame got destroyed with the work so they took some glue and painted above, the bathroom tub is not fixed and can be moved. They closed one part of the walls with a tile without removing the window, they installed a fake wall in front but forgot to close the window, so the window is open from the outside but can’t be closed because of the new wall. These, are just a few, really few things. In the contract we agreed that he would finish the work by the 19th of December, any delay causes an AED 1000 fine a day. أسئلة وأجوبة
