Recovering funds from a bounced check issuer who is abroad but still receiving a salary in the UAE

Q: Hi, I filed a case in the UAE over a bounced check for 100k AED. A judgment was issued against the check issuer, along with a travel ban. The problem is, the person has already left the UAE but is still receiving a salary in the UAE, paid into the same bank account the check was issued from (20k per month). Is there a way to deduct from their future income, or do I have to wait until they attempt to re-enter the country?

Can I update my visa if I filed an appeal to reduce the fine in a criminal case?

Q: I have a criminal case against me and I filed an appeal for it after the judgment because I got a fine in the judgment and I can`t pay that much amount of fine. What do I need to do now? Recently I added my surname to my passport and I got it now. So I need to add the existing visa to my new passport and update my name with my surname on my visa and Emirates ID as well. Do I need a police clearance for that or it can be done normally without any issues? If there is anything related to my case or complaint can I do it with a clearance letter?

How can I file a case against my previous landlord if he rented the apartment after evicting me?

Q: I want to file a case against my previous landlord as I found out after a while (7 months) after I moved out that they evicted me to rent the apartment with a higher rent. I was checking the type of cases that I can open in RDC (Mediation, first instance, appeal, enforcement) and couldn`t know which one to use, any advice? Also, is a screenshot from Bayut and the title deed enough as evidence? I verified the title deed on Dubai Land and the owner is still the same and just found out that the apartment was rented on Bayut with higher rent after I left.

Removing husband's surname from Indian ex-wife's passport using a Dubai divorce judgment

Q: Dear Lawyers, My wife and I (Indian nationals) have been divorced in Dubai by the Dubai Court, and we have stamped the court judgment at the Indian Consulate in Dubai, the UAE Ministry of Justice, and the UAE Ministry of Foreign Affairs, granting her custody of the children. My ex-wife now wants to remove my surname and home address from her passport. Can she get this done at the BLS Passport Office in Dubai by showing the Dubai court judgment, which has already been stamped by the Indian Consulate? Her passport was issued in Dubai. She is saying that the Indian passport office is NOT recognizing the divorce granted by the Dubai court. Can this be true, or is she lying? The Dubai court judgment is already stamped by the Indian Consulate in Dubai, the Ministry of Justice, and MOFA. Is it necessary to get a new divorce judgment from India, as we were trying to avoid the cost, time, and effort involved in Indian courts? Could you please guide me on this? What can I do if the tenant is subletting my property and not paying rent?

Q: The tenant is not paying and subletting nor getting utilities connected in their name. He also changed the door lock after moving in. His security cheques and rental cheques are bouncing & he knows that he will get a. notice so he is prepared for that too. He is part of a tenancy scam where these people pay the first month`s rent as cash then the security deposit post-dated cheque which gets bounced. Can we file a lawsuit directly or do we have to first send a notary notice for vacating and cheque bounce? Can one notice serve both? And can we go to our flat and get details of those staying there? Please advise. They also changed locks and only last month Ejari was signed.

Suppose a person gets into a car accident, and the accident report states that they are not at fault, with the medical report showing minimal injuries. Where should the claim be filed? Is it filed with the insurance company of the party at fault? If the insurance company fails to provide adequate compensation, what is the next step? The car rental company charged me extra amounts without proof. What can I do?

Q: I`m currently renting a car monthly. The monthly fee, full insurance, and deposit (1K AED) are paid. During the middle of the agreement, they charged me AED 925 without any previous notice. I checked for fines and the car looked clean, no fines. I contacted my bank and froze my credit card, but they asked me to contact the company first. As I already had transactions with them. The car rental made me wait 3 days to get the information, but they finally sent me proof of a fine with the plate number, date, and time, but without the location. The fine was AED 800, but they charged me AED 925. When asking about the price difference, they said that there are some salik charges too. Police say that they cannot do anything because the fine is already paid. My question is, can they really take from the credit card like that if I already paid a deposit for this kind of charge? How legal is it that they pay the fine without notifying me, and without giving me the chance to review the fine beforehand?

Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property

Q: Hi, I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building. The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024. One of the articles in the MoU states: In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates. I need help urgently.

Can I re-enter the UAE if I left without canceling my visa after my company went bankrupt?

How can I withdraw from a family business partnership while ensuring no liabilities?

Q: Hi, I’m one of three partners in a family business, where a father holds 50%, and two siblings hold 25% each, with 0% for the service provider. Does the service provider have any claims on the company if something happens to one of the partners? I’m currently the guarantor for a loan, and I have authority over vehicle sales and purchases. Can I terminate the tenancy contract is the tenant did not pay on the agreed time?

Q: I have a property to rent in Dubai and found someone to rent it. He paid the deposit and both parties signed contracts. The move-in date was the 12 September and he stated that he would pay the three cheques on the 12 September by 2.00 pm. No payment arrived on 12 September so we are planning to pull out. He did send a picture of 2 cheques and offered to make a payment late last night online for the first payment. No Ejari was registered as yet Can I pull out as the cheques were not delivered as agreed even though he offered late last night to pay the first installment online? The last online payment he made took 3 days to arrive in the account. I want to legally pull out. How do I do this and can I do it without any penalty? Does he lose his deposit and can he make a claim against me? If so, what does his legal action look like, i.e. what can he do? Regards

Can we contest the non-renewal notice and claim renovation compensation?

Q: Hi All, I need your advice, please. We got a shell and core office in June 2024 and started the fit-out works. It’s almost 80% done. Now the property management has given us a non-renewal notice for next year, so we will only stay for one year. We replied and told them it would be better to stop now, as we don’t want to complete the renovation just to move out next year. We asked for a refund for our initial payment and for the fit-out construction. To what extent or how much can we claim for damages, such as the time and effort wasted? Since April, we haven’t had an office because they made us wait for a few months. Is it possible to contest this non-renewal? What are our rights? Please advise! Thank you!
