Sending a 12-month eviction notice to a tenant before the end of the tenancy contract
Q: Hello, My tenant`s current tenancy contract is due for renewal on 24th July 2024 (the contract period end date is 24th July 2024). However, I would like to give a 12-month eviction notice to my tenant before the end of the existing tenancy contract. Can I do it? If I give a 12-month eviction notice on 15th July 2024, the end date to be mentioned at the time of renewal of the new tenancy contract would be the end date of the 12-month eviction notice, right? Please confirm. أسئلة وأجوبة

Can I cancel my house sale contract without extra fees after personal plans changed?
Q: Dear Lawyers, I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August. Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F. The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer`s real estate commission and the conveyancing fee. Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this? Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing? أسئلة وأجوبة

Is a non-renewable rental contract clause enforceable under UAE law?
Q: Dear Lawyers, While signing a rental renewal contract, the following clause is added: "This contract is a non-renewable contract, and the tenant agrees to vacate the premises at the end of the tenancy contract. He acknowledges that he has no right to file or claim in the future any lawsuit or compensation claim against the owner regarding this property, including what’s in it." The tenant signs the contract. My questions are: Q1. Is it legally enforceable within the UAE legal system, as it basically contradicts the basic rights of residents and tenants in the UAE? "No one has the right to prevent another person from resorting to the judiciary." Q2. This was used as a pressure instrument by the landlord as a condition of renewal after serving an eviction notice. This is all documented over emails. Q3. Can I sue the landlord for using the pressure tactic of serving me an eviction notice, pressing me for a rental increase, and making me sign this clause? All communications are documented. أسئلة وأجوبة

Can we legally dispose of tenants' personal belongings left in common areas?
Q: Dear Questioner, We are a company that owns a residential complex in the city of Al Ain, and tenants sometimes place their personal belongings in the corridors, which affects the general appearance, such as shoes, bicycles, etc. We always send them notices after they commit this act, and we have set regulations at the entrance to the building that prohibit it. Do we have the right to do this? Should we notify the tenant before disposing of any of their personal belongings, or is it not permissible for us to do so? أسئلة وأجوبة

Is a one-year non-renewability clause in a tenancy contract legally binding?
Q: Dear Lawyers, My tenancy contract contains a 1-year non-renewable term. I understand that even if this is written in the contract, it is not legally binding and they must still follow the proper procedure. If they don`t make contact within the 90-day period, are we entitled to stay in the apartment because they missed the threshold? أسئلة وأجوبة

Bank filed a civil case over a loan: Better to settle with the bank or in court?
Q: Good day, Sir, I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019. I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED. What will be the best way for me to proceed: approaching the bank or dealing with it in court? Best regards, أسئلة وأجوبة
