Can we cancel a car purchase under a 14-day withdrawal right without paying for value loss?

Q: Dear Lawyers, We bought a new car at a dealership but changed our minds for various reasons. When we purchased it, we signed a 14-day right to withdraw, which we now want to exercise. The dealer claims that we have to reimburse them for the loss of value since they have to buy it back from us (we`ve had it for a week and driven approximately 20 km, basically just back from the dealer). We see this as canceling our contract, not a buy-back situation. Are we in the right, and what should we do?

Can I collect rent from a subtenant while evicting my non-paying tenant?

Q: Dear Lawyers, My non-paying tenant, whom I have served notice to, is openly subletting my flat without any fear of the law. I received a call from the subtenant that my tenant has temporarily disconnected his DEWA and is threatening him to move out, while the subtenant is willing to pay me cash and wants to stay there. My questions are: - Is it possible to benefit from the sublet rent while the eviction case is being filed? - Should I get an RDC inspection done first to prove subletting by my tenant, and then accept money from the subtenant without any agreement for the period until my case is resolved? The people involved are a complete mafia who know the laws very well and will not pay a dime despite a travel ban, etc. - How can I ask the current subtenant to stay so that these individuals don’t sublet it again, especially with the high season approaching? - Also, can a criminal complaint be filed?

Switching the eviction reason to selling while intending to raise the rent. Can I renew at my current rate?

Q: Dear Lawyers, I have received an eviction notice from my landlord to vacate the property for his personal use. Then, in August 2024, he communicated with me via WhatsApp and email that he wants to sell the property. I met with him to find a solution, and he said that if I raise the rent, he will let me stay and renew. However, the price he is asking for is not justified, and according to the RERA index, no rent increase should be applied. To resolve this issue, I offered a 10% increase, but he refused. How to serve a notice of writ and obligation to pay when the debtor is unreachable?

Q: Dear Lawyers, I have initiated an execution case against a debtor. As the first step, I sent a "notice of writ and obligation to pay" to the debtor`s advocate. The advocate refused to accept the notice. Then I tried to send an email and SMS to the debtor. However, the court system said "No email found on Emirates ID" and "System refused to send SMS" because the debtor has outdated information on their Emirates ID. Question 1: Is a notice considered served 7 days after the court issues it, or 7 days after the debtor receives it? Question 2: What is the next step if email, SMS, and physical delivery to the advocate fail? I do not have the debtor`s physical address. 2.1 Is there a system to publish the notice on the court website? How do I petition for this? 2.2 Can I petition to publish it in a newspaper? How do I petition for this? 2.3 Are there any other steps I should take to notify the debtor?

The landlord contacted me, requesting confirmation on whether I plan to renew the tenancy or vacate, and they quoted a new rent 12% higher than the rent in the first year. The renewal terms and rates are not explicitly mentioned in the tenancy contract or the addendum. I understand that it is illegal to increase rent by more than 10%, but surprisingly, RAK RERA could not comment on this and failed to confirm which laws and regulations I could refer to. I am familiar with the renewal and rental dispute process via Dubai RERA, which is straightforward, but I am unaware of the process in Ras Al Khaimah. Seller backed out after manually signing due to DLD website outage. What to do?

Q: Dear Lawyers, I am a Dubai resident. I found a property in Dubai to buy through a real estate agent, and the seller agreed on the price I offered. At the time of signing the Sale Contract (Form F) on the DLD website, the system was down, so we signed it manually and gave the deposit check to the agent. The contract stated that the RERA system was down and that when it is back in operation, we should refile Form F digitally within 24 hours. The next day, the agent prepared it, and I signed it, but the seller refused to. He proceeded with the sale of the property to a different buyer and refused to pay the penalty stated in the contract. My questions are: 1. Is this legal? 2. Can he sell it to someone else even though he signed a contract with me? 3. RERA couldn`t block the sale because the contract was done manually and not registered in their system. Do I have legal rights to demand the penalty be paid or for the sale to go through? I have a copy of the sale contract with his signature.
