Liability for the repair of water leakage from an upper apartment
Q: We were told that there was water leakage coming from our unit and the below unit has complained. There was no water leakage found in our unit during the inspection. The technician said his engineer will decide. A week later, the FM engineer from Al Shirawi called my husband and threatened us to quickly proceed with rectification works and our unit is fully responsible for paying all the costs. We have requested them in emails to justify that indicated in their 1-page report - hacking bedroom tiles, new bathroom floor and grouting work. They have not replied to justify why. OA Menu has a RULE 6 clause 6.5 on a shared cost factor. Up till now, the OA Manager from SAGA Intl. kept on insisting that our unit is to pay all costs including any third party testings. He also demanded me to furnish a copy of the POA to him as I am the one who replies to the emails. My husband is the owner and we are staying in the unit. Does the OA Manager have the right to ask for the POA and ignore the OA Menu on the shared cost clause? Many thanks. أسئلة وأجوبة

Presenting evidence for deceit in defence of a bounced cheque case
Q: I need guidance regarding a civil case against my brother for issuing a cheque of AED 270000 having no sufficient amount in his account. The other person made some trade deal for selling precious stones to my brother and he took advance cheques from my brother and advance signatures on the invoice, LPO and delivery note. My brother trusted him but later he did not deliver anything to him and rather started blackmailing my brother to give the money otherwise he will make a civil case against him. My brother refused to pay any amount for the deal he never received, which resulted in making proper legal documents by the opposite party against my brother through a lawyer and made a civil case against my brother in Sharjah. Now, my brother is in Sharjah central jail since Jan 2017. Every month, he appears in the court and the judge asks him to pay money but he refuses every time & requests to call the opposite party to the court. Non-compliance with the dissolution agreement of a business partnership
Q: I had a partnership in a business before, but I agreed with my partner to sign a cancellation of partnership and he will pay me back my capital every month. He didn`t pay and it`s already 2 weeks. I filed a case in the public prosecution but it was rejected as the prosecutor is saying that it should go to the civil court. I don`t have the 10% for the civil court. Q: I`m on my husband`s permanent visa. Due to my delivery, I came to India in September 2017, and now I`m finding myself on the blacklist because of some minor robbery case. It is a case in which I`m not involved, as it is of my very close relative. My question is, how can I enter the UAE because it`s a matter of my self-respect and family. I want to fight against it. Is it mandatory to appear in court when you are summoned?
Q: I have a bank case of AED 64000 for which I was caught from Airport upon my return from vacation on Oct 3rd. I was detained in Naif police station and next day they gave me bail by keeping my passport. Now I have received a summons from court to appear before the prosecutor on Nov 5th. I`m really afraid if they will put me in jail again. I also didn`t go for negotiation with the bank as many of my friends advised me that there is no need for that as I will have to pay only a fine of AED 2000 for this. Is it true? Q: I own a business in Abu Dhabi (I am the 100% direct owner and I have a local service agent) and one client based in Saudi Arabia didn`t pay us for two years. If I close the business in Abu Dhabi, can I still sue the Saudi company and claim the money in the court even though the company will no longer exist, or I still have to maintain the license active? Breach of car repair obligation by the insurance company
Q: My insurance company (Oman Insurance) took 22 days to get an estimation of the reason being major damage. I inquired for a total loss and they said no as there was no chassis damage and the estimate was awaited. On the 24th day, I received a total loss offer letter from Oman Insurance asking to sign and acknowledge. I accepted the offer and sent back the document. 2 days later the garage told me that they were working in the car based on the word of the estimator in spite of no LPO. Oman insurance calls me and says that there was a miscommunication and the garage brought down the repair charges from AED 50000 to AED 20000 and that they will now proceed to fix the car. I did not agree with them as I found that the car had a chassis damage. Oman Insurance changed tune all of a sudden to the car only having minor damages and the chassis will be fixed. Q: Hello, this morning I went to a park with my three dogs and let two off the leash. My dogs ran barking towards a jogger, who got scared and ran towards me. After that, he called the police and took a picture of me and my car. The picture of me, he deleted then directly. Afterwards, I left with my dogs. What could happen in this case?
