Can my UAE employer claim ownership of my personal side project?

Q: I work for a large organisation with a head office and branches. My contract has a broad IP appendix that assigns all “Materials” created “in the course of Employment” (including software) to the company, along with a conflict of interest agreement regarding outside activities. In my spare time, on my own laptop and outside working hours, I am building a hobby analytics/automation tool intended to help my branch make better decisions and streamline workflows. There is no separate company, no external clients and no revenue. Branch management has verbally encouraged it, but nothing is in writing from the head office. Under UAE law and this contract wording: Can I get into trouble just for doing this project in my spare time? Is it likely to be treated as “Materials” owned by the company that I must hand over? What concrete steps/approvals do you recommend now to manage IP and conflict of interest risk?

What action should we take if an ex-employee overstays and works illegally after visa cancellation?

Q: We are a company based in Internet City Freezone holding a DDA license. One of our employees was relieved from duty on 11th September 2025, and her visa grace period of 30 days expired on 11th October 2025. She has not obtained a new visa and is currently working elsewhere illegally without converting her visa or leaving the country. On the cancellation paper, it is written that we must inform GDFRA of non-compliance. DDA has suggested filing an absconding case; otherwise, there could be sanctions on the company and blocking of the establishment card. What should we do, and who should bear the cost of this?

Do I need a UAE freelancer permit to work with US clients and receive payments in the UAE?

Q: I work as a Director of Project Management in a company in DMCC. During my free time, I have tried providing Project Management Consultation to clients in the USA as a freelancer on UpWork (an Online Freelancing platform) and have seen good traction. I want to pursue this further during my free time. I am currently holding a UAE Golden Visa. 1. I would like to know if I am required to hold a freelancer permit in the UAE if I only serve clients in the USA? I don`t have or plan to have any clients in the UAE or in GCC. 2. My clients in the USA have been paying me via UpWork so far, but I would like to receive this money directly via wire transfer to my UAE bank account or through online payment portals. Is this legal to do so? 3. I hold an NOC from my current employer to work on freelance projects during my free time. Can you please clarify the above questions? Jazakallah, Thank you!

Is it normal for an agency to charge a 5% commission on the total rent for a 3-year lease?

Q: Hi, I have negotiated a multiyear rental through an agency. I was expecting the fee to be 5% of the first year’s cost, but I now see the draft contract showing 5% of the total rent for 3 years. This does not seem to be standard practice based on what I’ve read. I would appreciate your advice. Thanks!

Is a registered email notice through Emirates Post valid for tenant eviction?

Q: Hello, I am the landlord, and my tenancy agreement is expiring on 31st December 2025. Last year, before the expiry of the earlier tenancy agreement on 21st December 2024, I served the tenant a one-year vacation notice through registered email via Emirates Post. The reason stated was personal use/sale of the property. I received a confirmation from Emirates Post. I have been told by my realtor that I should have served the notice through a notarized service. Can someone please guide me?

Can I legally stop working if my labour contract has expired and the company’s license is blocked?

Q: Hello, The company made a change of status for me, which expires on 7/10. My labour card expired on 23/9. I signed a 2-year contract, but they didn’t stamp the visa. The contract is now not showing in my UAE Pass app. In the MOHRE app, my 2-month contract expired on 24/9. Can I leave work now since the contract has expired, and the visa wasn’t stamped, and the contract is not showing in the UAE Pass app, which means they didn’t even submit it? I went to Tasheel, and they told me I can stop working as I have already filed a complaint with MOHRE for one week’s salary and Emirates ID fees. I started on 25/7. The employer paid me only for August. When I asked for my July salary, he gave me a warning letter with a 20% salary deduction. He then complained against me to MOHRE, but MOHRE closed his complaint. For my complaint, they asked me to keep working and wait for MOHRE’s final decision. What should I follow, as the Tasaheel agent told me the company’s license is blocked, and they will not process my contract, so he advised me to stop working and find another job?

MOHRE contract pending due to ILOE insurance. Who should pay for it?

Q: Hi, I signed the offer letter from India, signed the labor contract, and sent it to the company. They asked me to take the medical test and go to the consulate for the process, which I did. The company then sent an entry permit, and the consulate stamped the entry visa on my passport. I then took a ticket to AUH and reached Abu Dhabi on 23rd September. On the 25th, I took the medical test; on the 26th, I signed the MOHRE contract again as per the company’s request, completed Taujeeh, and the company initiated labor insurance and applied for the labor card. I can see the MOHRE contract is still in process and not attested. The card application status shows: “Application Status: ILOE Insurance not purchased yet. Please buy ILOE Insurance in order to continue.” My questions are: - Why is the MOHRE contract not being approved? - Who needs to pay for the ILOE insurance? Thanks for your support!

How can I sell a property registered under my minor daughters’ names within a month?

Q: Hello, I have bought a property and registered it under my daughters’ names. Their ages are 16, 17, and 20 years old. The property is on handover now, and we got approval to go for a mortgage. However, I have decided to sell it. What would be the easiest way to get approval to sell the property within 1 month and to have the revenue divided as follows: 70% from the selling price will go to a better investment, and 30% will go for their education? Please advise me. FYI: I was born in the UAE, and all my daughters were born in the UAE.

Are non-compete and training repayment clauses valid under UAE labor law?

Q: Hello, My wife, who is on my dependent visa in the UAE, has received a job offer. She plans to remain on her dependent visa, and the hiring company has included additional terms in her employment contract. These terms include: - A two-year non-compete clause, preventing her from working in a competing business in the UAE after leaving the company. - A requirement to repay AED 10,000 for training costs if she resigns within one year of starting the job. - A clause stating that resigned or terminated employees will not receive any bonuses or incentives after leaving. - A disclaimer that any clause violating the UAE Labour Law (Decree-Law No. 33 of 2021) will be considered invalid. Are these conditions legally enforceable under UAE law? Can I include a statement to ensure both parties are legally safe?

Will my father’s unpaid debts affect my re-entry to Dubai on a tourist visa?

Q: Hello, My father had some debts due in Dubai, and at that time, he was unable to pay them and still hasn’t. We left the country in 2017, but my mom and I were under his sponsorship, and we didn’t cancel our residency visas. Now I need to go back to Dubai on a work trip. I want to check if this might have any effect on me re-entering on a valid tourist visa. I’ve checked the ICP website, and it shows that my residence permit has been cancelled.

How to protect my residency when switching from a self-employed to an employer-sponsored visa?

Q: I currently hold a Self-Employed Residency Visa from the Dubai Development Authority (DDA – GoFreelance). I’ve been offered a new role with a U.S. university via an Employer of Record (EOR). Their attempt to apply for a labor card through MOHRE was rejected, as it’s not possible for free zone residents. They have asked me to cancel my current visa so they can sponsor me under an employment visa. My concern is that if I cancel my visa and the new employer/EOR withdraws or fails to complete the process, I’ll be left without valid residency. I’ve also been told new self-employment permits are no longer issued, only renewals, so I cannot easily return to my current status. Questions: - Does UAE law offer any protection in this scenario? - What risk-mitigation steps can I take/request before canceling? - If the process fails, what legal options remain for me to stay in the UAE?

What to do if you received judgment in absentia of fine and jail in a case after obtaining Tanazul?

Q: What does “Dispositioned” mean in a UAE - Abu Dhabi case? We have a Tanazul, but the case status is showing Judgment Done, with a 15,000 AED fine and 6 months` prison reserved. Does this mean he will go to prison? We missed one hearing on 28/08/2025. After that, we thought we had Tanazul, so we went to collect the passport, as I am the surety for my father. However, at the police station, they stopped him, saying he had a Tameem. Please help and advise what will happen. We have Tanazul, but the judgment is already done, and no appeal has been filed yet. The status shows Judgment Done on 28/08/2025. We missed the hearing that day, the prison sentence of 6 months is reserved, and a 15,000 AED fine has been issued. What should we do?
