Q: The court ruled to consider the objection submitted by R., an Indian national, to the judgment in absentia issued against him as if it had not been issued and to oblige him to pay the court fees. The ruling was issued and read publicly on today`s date 3/6/2025 in the name of His Highness the President of the State, may God protect him. I want to know the meaning of this.

How to fight a criminal appeal without traveling to the UAE due to an active arrest warrant?
Q: Hello, The judgment against my brother is two years in jail and deportation in Ajman. He has filed an appeal and will attend the hearing online. Someone told him that any order involving jail and deportation requires the person to attend court in person. He is in Pakistan. If the judge asks him to appear in court personally, how can he come? He will be arrested at the airport immediately. However, he wants to fight this criminal appeal case. He can attend online via a link sent by the Ajman Criminal Appeal Court while staying in Pakistan. How can we inform the judge that he cannot appear in person as he has been outside the UAE for more than six months and a new visa cannot be issued due to the case and arrest warrant against him? Please guide us on how to get this appeal accepted without him coming to the UAE before the judgment.2025/03/09

Is a 3-month notice for non-renewal of our warehouse lease valid?
Q: Hello, We would like to ask for legal advice. Our company is currently renting a warehouse, and our contract ends in June. We have just received an email from the landlord stating that they do not wish to renew our contract once it expires. Please note that we were informed through a regular email, not via an Emirates Post registered email or Dubai Courts. They mentioned that they will use the warehouse for their own purposes. May I know if this is allowed, considering we were given only three months` notice? As I understand, a one-year notice is required for eviction. Does our case fall under eviction? Q: Hello, I`d like to know if there are license requirements in the case of active traders (stocks, crypto) operating as natural persons. If so, any view on sanctions/penalties for involuntary non-compliance (or how to regularize a situation proactively)? - By active trading, quite frequent in Dubai I believe, I mainly mean with a turnover above 1m AED (even without profit), strictly conducted for personal purposes (no clients/service provided), as an ongoing/daily activity, recurrent/organized, with possible use of leverage, etc… The activity is hence ‘personal active trading’, likely in a grey zone beyond ‘personal investment’ (not requiring any license). - By licenses, I mean a VARA-regulated license and/or a commercial business license (e.g. following the commercial transactions law in which speculative activities/virtual assets works can be seen as a commercial business). Q: Hello, In my current job contract, I have a 30-day notice period. I have already submitted my resignation, but I want to resign early; it’s 5 days before the end of my notice period. I rented an apartment and paid to discover construction noises next door. Can I terminate the lease without penalty?
Q: I moved to a new apartment in Dubai DIFC (paying AED 250,000 annual rent) and I paid in one cheque. There is construction next to my apartment which is quite noisy and disturbs me. This will continue for 2 more years. They start to go higher and louder. I`m in the 60th floor. As I record Podcasts and work from home, I need a silent environment. In my contract, it is written: "In the event of the Tenancy being terminated by the Tenant before the expiry of the Tenancy Period, the Tenant shall be liable to pay 2 months’ rent as a penalty for such termination. The Tenant shall give notice of not less than 2 months." Would it be possible for me to get out of my lease agreement without penalty? I can stay 2 more months and give notice, but I wouldn`t like to pay the 2 months penalty (46,000 AED). Would it be possible to force the landlord to put soundproofing on his cost? A company that does soundproofing could add a glass layer and soundproof one room for 20,000 AED. Many thanks for your help A.+3
