I only have AED 2,000 left in my account, which is for my treatment and medication because I have breast cancer. Q: Dear Lawyers, I am a tenant in Dubai and rented an apartment five years ago. It was understood that I would stay in the apartment with my two friends, but this was not documented anywhere. Today, the landlord is unhappy with the rent amount, as rents have risen higher than he can legally increase it. In my latest contract from this year, a line was added in the additional comments stating that sharing is not allowed. Q: I have been renting an apartment in Dubai for 5 years. The landlord was not happy last 3 years as they were not able to raise rent more than the RERA calculator. In 2023, they sent me an email, non-notarized, asking me to evict the property for the reason of personal use. I refused this as it did not go through court and the contract was renewed for another year. This time, in 2024, they sent a court eviction notice with a reason for sale. It was sent 12 months before the end of the contract. In the period since the notice was sent, they did not try to sell the property or list it anywhere for sale. Can I get the rent cheques back if I decided to cancel the tenancy shortly after signing the agreement?
Q: The landlord has entered and signed a 1-year tenancy agreement with a tenant on 10.10 with a move-in date 4 weeks later, and on 07.11. collected 4 cheques (3 + 1 security deposit). 1 day before moving in the tenant decided to abruptly cancel and demanded for the cheques not to be deposited. Ejari has not yet been registered as it was planned to be done after the key handover. Is the landlord entitled to deposit the cheques (security cheque + 1 cheque) and demand 2 months` rent as a penalty? The tenancy contract has no explicit early termination clause. My previous landlord served me a notice to vacate. Can the new landlord vacate me without a notice?
Q: My previous landlord served me a notice to vacate, stating he intended to sell the apartment, which he later sold to a private company. From what I understand, this notice should transfer to the new owner, who would only be allowed to either sell the unit or move in themselves and cannot ask me to vacate to re-lease for higher rent. We are closer to the 12-month notice expiry and the new owner (a private company) is now demanding a significantly higher rent—above RERA’s allowed increase—or insisting I vacate so they can lease it again at market rates. The demand is more than 50% of my current rent. Is this demand from the new owner valid? I called up RERA who couldn’t help and advised me to approach a lawyer. Is the manager of the company liable if his name remains on the license after resignation?
Q: I was registered as a manager or signatory for a company. One year ago, I resigned, lost access to the company’s documentation and bank account, and had my visa canceled by the employer. Currently, I am working in a new company in the UAE with a new visa. I recently revealed that my name is still on my old company’s trade license for an unknown reason. I was registered as a manager in that company based on a Power of Attorney. I am not an owner or a shareholder of that company, and my name is not mentioned in the MoA of my old company. To my knowledge, the owners and managers threw up their company, left the UAE, and did not care about the company’s fate. The company has never operated and has no money in the bank account. What should I do to remove my name from the trade license if the owners do not respond to my messages?
