Given the expired lease and invalid eviction notice, can I stay and continue to pay rent?
Q: Dear Sir/Madam, My landlord gave me notice on plain paper last year when the lease was renewed. He wrote two reasons for eviction: one that he may sell the property and the other that he may move in. The eviction letter was signed by him only, but the property has two owners (husband and wife). This year, when he asked me to vacate the property, I informed him that, according to the RDC, the notice needs to be from a notary public or sent via registered mail. I then submitted an Offer and Deposit with the RDC, but the landlord didn`t respond. The lease expired on May 10th. The landlord hasn`t followed up with anything so far. According to RERA, the rental contract is automatically renewed unless terminated by the courts (for non-payment, eviction, etc.). What course of action should I take now? Should I send an email to the landlord with the cheques, mentioning they are ready since I already submitted the Offer and Deposit, or should I file a case? Or should I wait for the landlord to approach me or file a case?

How to come back to the UAE if I left with a credit card debt that accrued through time?
Q: In 2010, I was permanently banned from the UAE. At that time, I had a credit card from a bank with a limit of AED 5,000. Due to harsh circumstances, I was unable to inform the bank before being deported by the authorities. I did inform the bank afterward but, due to inflation and my financial situation, I was unable to repay the debt. It has now been 14 years, and the bank is still pursuing me for the outstanding credit card balance, including the accrued interest, which now amounts to approximately AED 143,000. I would like to inquire if I am still liable to pay this amount after all these years, including the interest. I have heard that banks typically do not follow up on such small amounts (AED 5,000) for an extended period. Could you please provide assistance and clarification on this matter?2024/05/21

My husband left me and my kids without financial support. What can I do?
Q: Good day. My husband left me and my kids. He is British. I’m Asian. He is still in Dubai. I asked him to put in writing the financial support that we would get without divorce as the solution. What document should I process? Also, my kids are British. Is it possible to get my UK visa through them? I only have a tourist visa but not residency as I understand we have to live there for 5 years. I don’t have any means to support myself when we get there. What to do if I have a case to pay the amount of two bounced rental cheques?
Q: I live in a Sharjah flat. Two of my cheques bounced and the third cheque went smoothly. Now my building real estate lawyer doesn`t want to take one payment at a time. He wants the full money of two bounced cheques plus the lawyer fees, which is huge too. Is this fair?

How to claim my share in a company from a partner who is trying to put hand on everything?
Q: On June 23rd, I was introduced to a gentleman through a friend to partner with on developing a new software solution. For his end of the deal, he was to produce 45% of the software to a spec which was agreed in June, and then once it was built to that spec the company would take over payments. The company was established Aug 23rd. In September, he started asking for payments for 50% of the costs, circa 10k Euro or development would stop. To date, I have paid almost 70k Euro to him for the development. The software only became useable, still not to the agreed spec around 90 days ago. Since then he has been trying to get myself and my wife (jointly we own 45%) out of the company through various means. He tried to steal the domain by accessing my personal Tasjeel account to transfer to his own but this was stopped. He is now threatening to force company closure, no refund of our money, and keep the software for himself. What can we do? He has used almost all my cash to date to get to this point.

Developer asks for full year's service charges despite purchase at year-end. Can I refuse?
Q: Hello, I bought a property from a developer in Q4 2023 and got the keys handed over in November 2023. They have returned to me to pay additional service charges for the entire year although I purchased the flat from the previous owner in the last quarter of the year. I sent them multiple emails to explain the reason behind it and to ask them to send any legal statement showing that the new owners are responsible for paying additional fees, though this is unfair from my perspective as I have been the owner of the property starting from Nov 2023. Some friends told me that they received a letter from their lawyers which they sent to the developer questioning this procedure and refusing to pay this. Since I don`t have such a statement to send to them as well, is there any opportunity for somebody to help me in writing one, hopefully getting the chance not to pay the additional fees? Thanks!

An Ajman company driver died in a Sharjah accident. Which court for insurance?
Q: Dear Sir/Madam, Our company driver passed away in a road accident. He hit a heavy truck from behind and died on the spot. His family is in his home country. I have obtained the legal heirship certificate and had it attested. The insurance company requires a letter from the court mentioning the amount to be disbursed. The policy clearly states AED 200,000.00 in case of death. That is what we are hoping they will pass on to the family. Which court should we approach in this case?
