س: السلام عليكم، لدي مشروع بناء فيلا في عجمان. بعد الانتهاء من البناء واستلام المقاول جميع دفعاته طلب مني دفع مبلغ 65 ألف درهم بغير وجه حق. يدَّعي أنها للعمالة الإضافية والضريبة، مع أن العقد شامل، وقد تأخر في التسليم 3 أشهر ويقول إما تدفع وإما لا أصدر لك شهادة إنجاز. ما الحل والطريقة الصحيحة؟

What laws apply to goods sales, and what about delayed payments?
Q: Dear Sir/Madam, A total of 3 consignments of spices were exported to a Dubai-based company. The payment terms were 50% against AWB and the rest after 15 days of delivery. After the delivery of the 2nd transaction, we got the first part of the payment. Upon sending the 3rd consignment, the company complained of quality issues in the product shipped in the second consignment (after 14 days of delivery) and released the 50% payment for the third consignment also. No further discussions were made regarding the second consignment`s quality. They assured to release the payment as per payment terms. As soon as the third consignment reached, they again complained of quality issues about the size of the product. We asked them to return the goods and not sell them further. They have sold the goods and after 20 days, are demanding a lab test on a very small quantity of goods remaining with them and are not releasing payments. What laws apply to the sales of goods and their payments? What recourse do we have?

Can the court expert extend the timeline of delivering his report?
Q: In my misdemeanor case of 150,000, the case is in the upper court and is with the Ruler`s Court expert. The case went to the Ruler`s Court expert in October 2023, and the expert picked the case in Jan 2024. He said that the report will be ready in Apr 2024. Now there is a 2-month extension. Is there any timeline as to how much time the expert can take? Also, is there a maximum time as to how much time the case can stay in the upper court?

Q: Dear Sir/Madam, I am currently facing a complex situation involving a business partnership gone sour. Two years ago, a friend and I embarked on a bed space business venture without obtaining a trade license. While I covered the full investment, my friend took responsibility for managing the flat. We agreed to split the profits 50-50. However, over the past 8 months, he has been withholding profits and not contributing to utility payments, leaving me to bear the losses. Despite my repeated requests for reimbursement, he consistently delays payment. Recently, he renewed the flat in his name and is claiming ownership. Furthermore, he has replaced me with another partner and refuses to compensate me for my share of the goodwill amount, which amounts to approximately AED 30,000. If I wait until the MoU expires, will the apartment purchase auto-cancel?
Q: Hello, Legal Advice Middle East I am writing to seek your advice on my ongoing process of buying an apartment in Dubai Marina. I have signed an MoU with the seller, it is valid until 21 May 2024. I have done the valuation process but the result was not reaching the selling price at all so I couldn`t proceed with the mortgage. In good faith, I was seeking another way and was willing to conduct a 2nd valuation and pay for it again, and still, the result came out unfavorably again for the 2nd valuation. This means I cannot get the mortgage from the bank at 80% of what I am hoping for. Therefore, I would like to ask the seller to either sell the apartment to me at the valued rate or cancel the MoU altogether and not proceed with the sale. My questions: Can I just wait for the MoU to expire on 21 May without doing anything? Would this cancel the MoU automatically if it`s reached expiration? Can the seller sue me and get the 10% deposit cheque amount? What would you suggest I do in this case?2024/04/26

Bank rejects my dispute for unauthorized transactions. What next?
Q: Good day, I`m using a credit card with one of the banks in the UAE. I received an SMS stating that my card was added to Apple Pay, followed by a debit transaction of AED 15,000, then two OTPs, and finally seven debit transactions. By the time I blocked the card, a total of eight transactions had occurred, amounting to more than AED 90,000. I immediately called the bank after blocking the card and reported all the fraudulent transactions. I also sent Dispute Forms the same day. The next week, the bank sent me an email rejecting all dispute transactions, stating that they were done in a secure environment with Apple Wallet, etc., and were tokenized transactions. Now they are asking me to pay all outstanding amounts. I did not authorize these transactions, never entered any OTP anywhere, and informed the bank within less than one hour of these fraudulent transactions. How can I resolve this situation? Do I have a chance of winning if I file a civil case?+1
