Q: Dear Lawyers, I have a tenancy contract in Ras Al Khaimah, expiring on January 1, 2025. This is my first year of tenancy with this particular landlord, and I intend to renew for a second year. The landlord contacted me, requesting confirmation on whether I plan to renew the tenancy or vacate, and they quoted a new rent 12% higher than the rent in the first year. The renewal terms and rates are not explicitly mentioned in the tenancy contract or the addendum. I understand that it is illegal to increase rent by more than 10%, but surprisingly, RAK RERA could not comment on this and failed to confirm which laws and regulations I could refer to. I am familiar with the renewal and rental dispute process via Dubai RERA, which is straightforward, but I am unaware of the process in Ras Al Khaimah. Seller backed out after manually signing due to DLD website outage. What to do?
Q: Dear Lawyers, I am a Dubai resident. I found a property in Dubai to buy through a real estate agent, and the seller agreed on the price I offered. At the time of signing the Sale Contract (Form F) on the DLD website, the system was down, so we signed it manually and gave the deposit check to the agent. The contract stated that the RERA system was down and that when it is back in operation, we should refile Form F digitally within 24 hours. The next day, the agent prepared it, and I signed it, but the seller refused to. He proceeded with the sale of the property to a different buyer and refused to pay the penalty stated in the contract. My questions are: 1. Is this legal? 2. Can he sell it to someone else even though he signed a contract with me? 3. RERA couldn`t block the sale because the contract was done manually and not registered in their system. Do I have legal rights to demand the penalty be paid or for the sale to go through? Will revoking the NOC I gave my wife help her leave without paying 3 months' notice salary?
Q: Hi, My wife is currently working in a nursery under my visa as a Teacher`s Assistant. I was suddenly relocated by my company to another emirate, and my wife and son will accompany me. She is under a labor contract with her company, and her Adek pass is under the company. She wishes to leave without notice because her position will not affect the activities of the school. However, her manager is requesting 3 months` notice or 3 months` salary before she can leave. I need advice on what to do next because this is not stated in her contract, and she is not a teacher who would need to pay such an amount. Will revoking the NOC I gave her to work solve the issue? I even offered for her to pay 1 month of her salary plus the labor contract money so we can relocate, but the manager is still refusing. What can I do? Q: I am being pursued for a debt of 290,000 dirhams in the UAE by twofour54, the media free zone in Abu Dhabi. The debt is historic, 10 years old, and it is a company debt, not a personal one. I am a UK citizen currently visiting Dubai and wish to contest the disputed amount. I was the general manager, so I’m unclear why I am being pursued personally. Can a settlement be negotiated? Can we terminate a staff member who did not return to work after annual leave?
Q: Hello, We have a staff member who was supposed to return to work on 15 September 2024 from annual leave (they went back to their home country). However, after trying to reach them, they finally told us on 12 September that they have a travel ban due to legal issues that they are being accused of. They said that they have a hearing on 13 Sep and will update us on the matter. However, we have not heard from them since then. We have tried to contact him but nothing. What are our options here? We unfortunately cannot keep waiting for them (as operationally, we needed him back), and due to this being a legal matter (we don`t want him to work for us anymore, it seems serious). Would Article 44 Clause 8 apply here?
