Should I visit the Evacuation Department in person to complete the eviction and get my keys?
Q: Dear Lawyers, I opened an execution case against my tenant who was not vacating the apartment and was not paying the rent. After the execution date, I received a report from the police that the apartment is being evacuated. However, when I created a "Request to follow up execution proceeding" e-request to complete the process and get the keys, my request was rejected with the message "على مقدم الطلب مراجعة قسم الاخلاء," which translates to "The applicant must refer to the Evacuation Department." So, do I need to personally visit the Evacuation Department? I am outside the UAE but can come to the UAE to get the keys. Or, do I need to create an e-request in a different category?

Can I sue my landlord for cutting off utilities during the pandemic?
Q: Hello, During the pandemic, I was unemployed and living in a one-bedroom apartment with my wife, who was also unemployed, and my five-year-old daughter. Since we were not working for roughly two years, from the beginning of 2020 until the start of 2022, I was unable to pay rent. The landlord`s office could not evict me as all such procedures were on hold by RDC, so they resorted to disconnecting electricity and water since the DEWA account was under their name. This resulted in my family and me living in the house without electricity or water from March 2021 until February 2022, which was the eviction date. Due to these harsh living conditions, my young family and I suffered immense moral and financial losses. During this period, I made several attempts in person and by email to restore the DEWA service upon payment of a partial amount, but to no avail. I want to know if I have legal grounds to sue the landlord for this action and demand compensation.

Can I charge my friend with breach of trust for not sending money from my property sale?
Q: Hello, I gave an online POA to my friend, who has a UAE residence visa, to sell my property. I gave another online POA to his brother to receive money on my behalf. I do not have a residence visa. They did not provide me with a copy of the POAs. He sold my property in JLT, and his brother received the money, but they did not send the money to me. Can I now open a case against them with the charge of "breach of trust" or any other charge that suits this case? Thanks a lot!

How to stop the managing agent from banking the rental cheque after vacating the property?
Q: Dear Lawyers, My family member has a case against his landlord and managing agent at RERA, which has been set for a hearing next month. He has vacated the property and given notice of cancellation, but the managing agents are ignoring him and refuse to provide the landlord`s contact details. In the meantime, the managing agents indicated they will still bank the next rental cheque of AED 100k (for six months` rent). Is there anything that can be done to stop this? My brother isn`t in a position to pay this money as he had to find other accommodation, but he doesn`t want to face any legal issues if the cheque bounces.2024/08/09

Is an MOU still binding after delays due to rain if it contains a force majeure clause?
Q: Dear Sir/Madam, I signed an MOU on March 22, expecting building completion in April. The MOU had an expiry date of April 22; however, due to rain on April 15, the completion was delayed until May 30, 2024. I received the BCC on June 17 from the developer and paid for the pre-title deed on the seller`s behalf to expedite the process. Now, I have completed the pre-approval and valuation, but the bank is asking for the handover notice to release the final cheque, which the seller is refusing to share. The seller claims the MOU has expired, but it includes a force majeure clause. So, is this MOU still binding or not?

Can I cancel my house sale contract without extra fees after personal plans changed?
Q: Dear Lawyers, I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August. Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F. The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer`s real estate commission and the conveyancing fee. Our understanding is that the 10% penalty is the only penalty. Which is correct, and what are the next steps to dispute this? Also, is there any way to dispute the 10% itself under the law due to personal circumstances changing?

Is the appeal court's decision implemented automatically, or is an execution procedure required?
Q: Hello, I kindly ask for clarification of the following situation: The Dubai Family Court of First Instance gave the father visitation rights, and he has a Sharia Execution Case for implementation. At the appeal, it was a tragic verdict: the judges rejected his visitation rights because the marriage was invalidated due to religious differences. - Is this decision implemented automatically, or is there an execution procedure, with an execution writ, similar to the first instance? - Is it possible for the father to still meet the child until the execution procedure is completed? - Does Chapter 5 of the Federal Decree by Law on Promulgating the Civil Procedure Code, which deals with Executing Execution Writs and Decisions Related to Personal Status Matters, apply to the appeal or only to the first instance? How is Article 322 of UAE Civil Procedure Law interpreted?
Q: Dear Lawyers, Conditions for placing the manager of a debtor company in jail. Article 322 of UAE Civil Procedure law states as follows: "If the debtor is a private legal entity, the order shall be issued for the imprisonment of who represents the company legally or any other person if the refusal from execution is attributed to them personally." Does "the refusal from execution is attributed to them personally" apply only to "any other person" or also applies to "who represents the company legally"? If I ask for the detention of the manager or partner of a company, have I to prove that the manager/partner is refusing to execute the writ? This is a general question regarding the interpretation of the law. It is not linked to my cases or documents.2024/07/11
