Can my employer demand repayment of salary after acknowledging an increase?
Q: Hello, I currently work for an American company based out of the US, but my contract is through a legal entity in the UAE. I received a salary increase last December. I had to sign a salary increase document. I have been getting paid that salary since. Now the company has a registered entity in the UAE. While they were reviewing the financials to transfer our contracts from the current local entity to the new one, HR claims they made a mistake, stating that I have been overpaid. They are asking me to revert to my previous salary and pay back the extra money I received. I have the signed contracts and the emails where they are admitting that error. Note that the new salary has been submitted to the involuntary loss of job insurance, and I have also applied for a bank loan using the new salary, providing certificates from my current local employer with that salary to secure the loan. Judgment in our favor: Who should we pay—landlord or court?
Q: Hi, I have had a rental dispute with my landlord about a rent increase. We submitted an offer and deposit, which was approved, but the landlord ignored it and filed a case for eviction, claiming we hadn`t paid rent or communicated. The judge ruled on this case saying: - Eviction rejected. - Rent increase rejected. - We are to pay all dues up to the judgment date based on the same conditions as the previous year`s contract. - The landlord is to pay all expenses and fees. Q: Dear Lawyers, My wife is the owner of a villa in Dubai, and in September 2023, she issued an eviction notice to the tenant on the grounds of self-use. In August 2024, the tenant vacated after serving the notice, and the tenancy contract has ended. Now, our situation has changed, and we would like to re-rent the villa to a new tenant. If my wife transfers the villa to my name via a gift deed, will I be able to rent the villa after the transfer of ownership is completed? Q: Hello, Our building management is changing, and we have a contract with them until November 15, 2024. We have paid up to that month. On August 24, they messaged me on WhatsApp that they are changing management effective September 1, 2024. They only gave us a 7-day notice, which was not written but only communicated via WhatsApp. The new management is now saying that they will increase the rent to 70K, while our current rent is only 46K. On sick leave. Can my school make me resign? What are my rights if they do?
Q: Hi, I’m a teacher in Dubai and have been given a medical note for sick leave due to mental health. I am currently still in the UK because I found boarding the plane extremely overwhelming in my state, so my sick note was issued by UK doctors. Do I need a Dubai sick note too? My school has given me the option to resign, but I don’t want to do this as I plan to return to work after receiving therapy and medication. What are my rights? I have worked at the school for a year and have a total of three years of teaching experience in Dubai. This is the first time I have ever needed medical sick leave in my entire 10-year career. I know that labor law states I am entitled to 90 days of sick leave, and I don`t think my school can dismiss me. However, if they do, will I be entitled to any pay or gratuity? Thanks!
