Do you have to send the tenant a new eviction notice after purchasing property?
Q: I purchased a villa in Jan 2023 which had a 12-month vacating notice by the previous owner for the reason of selling the property (tenant to vacate 30th June 2023). The tenant now informs me that he is not obliged to vacate as the reason for vacating is no longer valid since the property is sold and I am the new owner. Now the tenant is mentioning that he believes a fresh notice needs to be given with another 12 months` notice. When I called the RDC of RERA, they mentioned that the new owner needs to give fresh notice. A landlord rented out the apartment at a higher price after I moved out. What to do?
Q: Dear Sir/Madam, I have just found proof that my former landlord in Dubai rented out my old apartment at a much higher price to a new tenant the month after I moved out. I also have proof that he was “intending to sell” the apartment in a message. I signed a contract stating that I would move out at the end of the lease, which I did, based on his advice that he is selling the apartment. I received an official legal notice with “sale” as the reason for eviction four months after I signed the contract. Q: Hi, We have an apartment that we are trying to sell and we also have a tenant living there. Her contract is until the end of May 2023. We sent her an eviction notice through notary public on Dec 2022 and she has 1 year to vacate the apartment. She wants to extend her contract from May to Dec as she is still allowed to stay til December as per notary notice. Is the notice to vacate still valid after the agreement to renew the tenancy?
Q: Hi, My landlord sent me a 12-month notice to evacuate because they wish to sell their apartment. They initially wanted to increase the rent, but I spoke to them and agreed to the increase. We then agreed to renew the tenancy agreement based on the rental increase. However, I still have the notice because the landlord said she was unable to cancel it, as there is no option to cancel on the system. She said that once we renew the contract, the notice will be automatically invalidated. Is this true? I am renewing my contract in accordance with their terms of rent increase, but the landlord has been unable to retract the notice. How does she invalidate or retract the notice? Can a landlord increase rent above RERA limits using DLD valuation?
Q: Dear Sir/Madam, My landlord in Dubai wants to increase my rent by an amount that is double the permitted increase by the RERA index (10%). I have insisted on capping the increase at the RERA index amount (5%). The landlord is threatening to request a Dubai Land Department (DLD) valuation, which he says will override the RERA index amount and likely result in a much higher increase (he says up to 40%). Can the landlord evict me or increase the rent by sending a two months notice for that?
Q: My landlord wants to evict me (60 days notice) because he wants to sell the property. I told him that he has to give me a 12 months notice which he sent and we received. He also wants to increase the rent above the RERA Index Calculator. I informed him that I am not willing to pay the increase above RERA calculator and also because he did not give us a 3 months notice for the increase and asking me to leave in 2 months. He does not want to renew the contract saying I did not confirm to him my intention to stay (as per contract it says 2 months notice to be given by the tentant or landlord if they want to stay or leave) and that I should leave in 2 months. I am aware that he knows we want to stay since we are discussing rent and eviciton in 12 months the landlord is using this now to evict us.
