How is Article 322 of UAE Civil Procedure Law interpreted?
Q: Dear Lawyers, Conditions for placing the manager of a debtor company in jail. Article 322 of UAE Civil Procedure law states as follows: "If the debtor is a private legal entity, the order shall be issued for the imprisonment of who represents the company legally or any other person if the refusal from execution is attributed to them personally." Does "the refusal from execution is attributed to them personally" apply only to "any other person" or also applies to "who represents the company legally"? If I ask for the detention of the manager or partner of a company, have I to prove that the manager/partner is refusing to execute the writ? This is a general question regarding the interpretation of the law. It is not linked to my cases or documents.

Transferring property ownership to avoid higher support payments upon divorce
Q: Dear Lawyers, My wife has filed an appeal after the court earlier rejected her divorce request. Please note that she left the marital home without my permission. In her appeal, she is requesting higher marital support payments, pointing to my ownership of a flat in the UAE from which I earn rental income. She has provided property documents showing the flat is under my name and is asking the court to consider this in addition to my salary. I am considering transferring the property to my mother`s name to prevent her from monitoring it in the future and making any further claims. Will it be useful to transfer the property to my mother`s name at this stage? I will contact whose advice appears most suitable for a detailed discussion.

Brother detained for 25 days after an accident; no bail due to investigation. What to do?
Q: Dear Sir/Madam, My brother has been in Buheira police station for 25 days now. He had a minor accident in Sharjah that resulted in dents to two cars. They took him that day and said they needed to do drug tests on him. It`s been 25 days now, and the results have not come back. They say it will take more time. We are unable to get bail because the lawyers say it shows as "under investigation" online, and until the investigation is over, we cannot get bail. We don`t know what to do because the test results may take much longer, and we`re not sure how long we have to wait. On July 1, 2024, I submitted a resignation letter with the intention of providing a notice period until July 26, 2024. However, my employer refused to accept the notice period and stated that I am only obligated to work until the end of my probation. Do I have to send the tenant an eviction notice after buying a villa in Dubai?
Q: Hi We are in the process of buying a residential villa in Dubai which is currently tenanted. The seller did not issue an eviction notice to the current tenant. However, the following sentence was added to the contract: “As agreed, this will be the last renewal period for the tenant. The tenancy contract will not be renewed or extended. At the end of this contract, the tenant will vacate the property on 11/01/2025.” On the above basis, is the tenant obligated to vacate on the above-mentioned date even after the property is transferred to me? If so, do I need to send them an eviction notice for 11/01/2025? Or a 12-month notice would need to be sent? Thanks In advance
