Can a new developer cancel my old SPA and take my unit if I refuse to sign the new SPA?
Q: Dear Lawyers, I have a question regarding a new developer taking over a property from an old developer who fled Dubai many years ago. The new developer is trying to get investors to sign a new SPA, which includes additional fees. I have not signed the new SPA yet. The new developer claims: "The Judicial Committee for Incomplete & Cancelled Real Estate Projects in the Emirate of Dubai approved the continuation of the project as planned and instructed the new developer to issue amended SPA contracts to all investors, taking into consideration that non-compliant investor contracts shall be canceled in accordance with the procedures and regulations applied." Accordingly, as per the verdicts, they request all investors to comply with the decisions and verdicts issued within a 15-day notice. I have paid 80% of the total fees, and the project is about 60% complete. Does the new developer have the right to cancel the old SPA and take my unit if I don`t sign the new SPA? Also, can I request the project to be completed?

Q: Dear Lawyers, Can a partner in an LLC company (Dubai Mainland) sell their shares to a third party without the consent of the other partners? If one partner wants to exit the company and the other shareholders are neither responding to this request nor giving permission, what is the way forward? How can I evict non-paying tenants after their cheque bounced?
Q: Dear Lawyers, I rented my apartment to a tenant. Before they moved in, they mentioned having a money issue and agreed to pay one month`s rent first. They said they would pay the deposit and the next month`s rent the following month. They also agreed to sign one open cheque for the deposit and one cheque for each month’s rent. In the one month they stayed, I received three notifications from the management team regarding violations of building rules, such as putting decorations on the door. At the end of the month, the cheque bounced due to signature issues, which implies that all the cheques cannot be deposited. I have tried to contact them, but they do not respond. I realize this could become a serious problem. What can I do now to reduce my loss and evict them? Thank you!

Obtaining a rehabilitation certificate for a Umm Al Quwain traffic case while residing in Abu Dhabi
Q: Hello there, I had a traffic case from the traffic court of Umm Al Quwain in 2018, which was completed and closed. When I tried applying for a PCC, it was rejected, stating I need a rehabilitation certificate. I visited the traffic court of Umm Al Quwain to get one, but I was told that because I reside in Abu Dhabi, I could not be granted the certificate there. When I came to Abu Dhabi, I was told that my case is from Umm Al Quwain and I cannot obtain it in Abu Dhabi. Can anyone help me with how to obtain the rehabilitation certificate and what the process would be?2024/08/02

A new owner wants to increase the rent beyond RERA guidelines. What should I do?
Q: As`salaam Alaikum, Good Morning! I live in Dubai and have rented an apartment since November 14, 2022, which I renewed on November 13, 2023, for a year at an amount of 41,800 AED (4 cheques). Three to four months ago, the owner sold the apartment to a new person, and I had to change 2 payment cheques to the name of the new owner, one of which has already been encashed. Now, as the renewal date (November 13) approaches, the new owner is asking for a rent increase of 5,000 AED. I live in Dubai Silicon Oasis, and according to the RERA rental index, the maximum rent increase is 2,090 AED, which I informed the new owner. However, the new owner insists that, according to RERA, they can increase the rent by 5,000 AED. I have researched extensively but found no information indicating that a new owner can increase the rent by this amount. Could you please clarify if the new owner can increase the rent by 5,000 AED? How should I proceed if the new owner goes against RERA guidelines?+1

How can I avoid lease renewal in Dubai after missing the 90-day notice period?
Q: Dear Sir/Madam, I am a tenant in Dubai, and my lease is expiring in one month. I do not wish to renew the lease; however, I forgot to give my landlord notice.
