Can wife's abusive messages compromise case against scammer?
Q: Dear Sir/Madam, There`s a guy who scammed me out of 150k AED with false documents. There`s already a criminal case ongoing against him; however, I wasn`t aware of it at the time of the dealing. Every time I tried to sort things out with him, he made me wait for hours and didn`t show up. In short, he gave me false hopes, and now he`s been completely out of touch for 4 months. When we were finally able to contact him, my wife sent him abusive messages out of frustration because he was spreading lies about us. Now, with all the evidence I have, I want to file a civil case against him. Could the abusive messages my wife sent backfire in any way? I have all the documents he gave, along with some voice notes where he clearly states that he scammed us with false documents. But this guy is very shrewd. When attempting to use the Dubai Land rent calculator, I encountered the message: "Rental index data is not available for this period and will be updated later." Data is only available until the end of March. If my contract were up for renewal now and I could use the rent calculator, there would be no increase in rent according to the calculator. Q: Dear Sir/Madam, I am a 50% owner of a leasehold property. The lease agreement does not specify joint or several liability. It only mentions "xxxx and yyyy" as the lessees. We have not paid service charges for the last 3 years. The other co-owner left the house 3 years ago and ceased all communications with me. The co-owner is uncontactable. The management company initiated an RDC execution case against me and my co-owner. Am I liable only for 50% of the total due amount? Or am I liable for 100% of the due amount? Is the landlord's claim true that the court must sign the deposit cheque so he can return it to me?
Q: Dear Sir/Madam, I recently moved from my old premises to a new one because the landlord wanted the tenants out after an inheritance case as he wants to increase the rent in the building. That case made the renewal of the contract impossible for months but once settled, I paid the amount in one go so I could move out. In order to avoid any issue, I moved out but the landlord is taking time to give me back my deposit telling me that some agent from the justice needs to sign the deposit cheque in order for him to give it to us. Therefore I wanted to inquire if that is true as I`m struggling now financially and that cheque would help me big time. I paid for moving out and moving in, in one go, which caused me a lot of expenses at once and that deposit cheque is more than needed. I gave them time, as they told me it needs 15 days, now it`s been 22 days and they`re still telling me the court agent did not come to sign the cheque. What can I do if the developer canceled my unit and did not refund my deposit?
Q: Hi, I paid a 24% deposit and 4% DLD and my SPA was voided the next day after I signed the SPA. After many emails and telephone calls to the developer, I was told that due to some issues with the booking, they could not proceed with the unit I booked. They were offering an alternative unit about 20 floors lower or a bigger unit at a higher price. Both alternatives were not acceptable. The developer then said that they would cancel and refund the money. I was waiting for their email to confirm this and was wondering what I could do if the developer did not return all the money.
