I'm renewing my tenancy contract and the landlord wants to increase above RERA index
Q: Hello, I hope you are doing well! I really need some advice. I`m renewing my contract in a few months and the landlord was asking for AED 60000. The maximum increase according to the RERA index is AED 50,820 which was my proposal. The owner responded by saying that they want AED 55000 as the rent. I am confused because I thought by law the maximum increase would be within the RERA index. If I don`t agree to the owner`s rate, would I be compromised in any way? Please assist me. Is it worth filing a case for compensation if the landlord evicted me and did not sell?
Q: My landlord has asked us for a 33% rent increase and I responded by informing him that according to Dubai law, the maximum rental increase he can impose on me is 20%. He then replied back and gave me 24 hours to respond and agree to the 33%, or else he will evict me (all communications have been done through email). 2 days later, I received a 12 months eviction notice through the notary. The eviction said it was for the reason of selling his property. Fast forward, I moved out at the end of the 12 months. Then less than 2 months later (48 days later), he rented the property to another tenant for a higher price (I have managed to obtain a copy of the Ejari of the new tenant). My question is: Is it worth it to go to the RDC and file a case? Or is this a gray area in the Dubai rental law, and there is a chance that the judge won`t order the landlord to pay any compensation? Q: Dear Sir/Madam, I have a question about rental renewal and would appreciate your response. The landlord did not give us any notice of rent increase or renewal before the 90-day expiration of the contract. However, I gave the landlord written intent-to-renew notice by email before 60 days of the rental expiration. They explained on the phone that they would like to renovate the villa and therefore will not be renewing the rental contract. Can you please confirm what is the minimum notice period that the landlord needs to provide for eviction if they want to renovate the villa? Can landlords in Dubai increase rent if RERA index has not changed?
Q: Hi, I am an owner of an apartment in Dubai. It has been rented out for the past 2 years. The market rate of rent has now increased, however, the RERA index has not changed in the past 3 years. I gave my tenant a 90-day notice notifying him of an increase in rent, however, he is not accepting and will only pay as per the RERA index. The matter is now with the RDC, where he has filed a case against me. The RDC session is scheduled for next week. If I provide a DLD rent valuation certificate, will the RDC consider my request, or will they stick to the RERA index? In case the tenant wins the verdict, will I have to pay any legal fees? Can the landlord evict us to sell without giving a 12 months eviction notice?
Q: We were told by our landlord that he wants to sell his property. Our contract is till 11 December 2023. He said it would be difficult to renew our contract as we wanted to extend. We then gave him two options either we can try and find an alternative rental and he refunds us or he extends till June 2024. He said preferred we look for an alternative rental ASAP. This all happened on 3 June, we then looked for an alternative and found that rental prices have gone up considerably and this is not financially viable for us and have gone back to him on 4th June to say this. He has come back and said he has already signed the contract with a new buyer. What is our position? We only offered and were only subject to if we could find an alternative rental. A landlord rented out the apartment at a higher price after I moved out. What to do?
Q: Dear Sir/Madam, I have just found proof that my former landlord in Dubai rented out my old apartment at a much higher price to a new tenant the month after I moved out. I also have proof that he was “intending to sell” the apartment in a message. I signed a contract stating that I would move out at the end of the lease, which I did, based on his advice that he is selling the apartment. I received an official legal notice with “sale” as the reason for eviction four months after I signed the contract. Q: Hi, My landlord sent me a 12-month notice to evacuate because they wish to sell their apartment. They initially wanted to increase the rent, but I spoke to them and agreed to the increase. We then agreed to renew the tenancy agreement based on the rental increase. However, I still have the notice because the landlord said she was unable to cancel it, as there is no option to cancel on the system.
