Will UAE Courts allow child relocation after divorce if the father is Emirati?
Q: Hello, I am a European citizen married to a UAE national. We started the process of divorce last week. We have been married for 7 years and have a daughter. We will put in the agreement that I wish to relocate with her to my home country, where I own a home and also share the home with my parents. We have spent significant time there during these years, and my parents are here too, so my daughter is very attached to them. In the UAE, it`s husband, me and her; sometimes we meet with my mother-in-law, but other than that, there is no family environment. We agree on all the aspects of co-parenting (visits, alimony, video calls, schooling). He will also give notarized approval to submit with a draft, and I have attested the title of deed proving I own a place to be over in my home country. As much as separation is difficult, we are both aware that post-divorce life in two homes, with my daughter having no family at all around, will be even worse. Will the court approve the relocation? أسئلة وأجوبة

How can I recover money lost on an unlicensed online gaming site in the UAE?
Q: Unfortunately, I lost a significant amount of money on an online gaming site in the UAE. Initially, they told me they have a license to operate in the UAE. I started playing for entertainment and initially received some money. Later, I lost a large sum, which seriously impacted my life and even affected my basic survival, despite earning a salary of 15000 AED. After a few months, I discovered it was not a licensed site, although many people in the UAE were using it. Now, I am seeking advice on how to recover at least part of the money through any legal means. أسئلة وأجوبة

MOHRE contract pending due to ILOE insurance. Who should pay for it?
Q: Hi, I signed the offer letter from India, signed the labor contract, and sent it to the company. They asked me to take the medical test and go to the consulate for the process, which I did. The company then sent an entry permit, and the consulate stamped the entry visa on my passport. I then took a ticket to AUH and reached Abu Dhabi on 23rd September. On the 25th, I took the medical test; on the 26th, I signed the MOHRE contract again as per the company’s request, completed Taujeeh, and the company initiated labor insurance and applied for the labor card. I can see the MOHRE contract is still in process and not attested. The card application status shows: “Application Status: ILOE Insurance not purchased yet. Please buy ILOE Insurance in order to continue.” My questions are: - Why is the MOHRE contract not being approved? - Who needs to pay for the ILOE insurance? Thanks for your support! أسئلة وأجوبة

What are my legal rights if I face forced leave and defamation for refusing a salary cut?
Q: I seek your advice on workplace issues in Dubai. I work full-time at a consultancy. After annual leave, I faced false allegations and harassment, and was forced to leave after refusing a salary cut linked to deployment (beyond my control). I am registered as a Person with Disabilities (outside the UAE) and was twice hospitalized. While on forced leave, I also received an email (with the contractor copied) implying misconduct/theft, harming my reputation. Could you clarify my legal rights under the UAE Labour Law (Decree 33/2021), MOHRE, and Federal Court procedures regarding: - Protection from discrimination/harassment, - Salary cuts and forced leave, - Sick leave entitlements, - Defamation and reputational harm, and - Arbitrary dismissal and compensation. What remedies can MOHRE grant, and if escalated to the Federal Court, what compensation (lost wages, damages, end-of-service, moral compensation) might I reasonably claim? أسئلة وأجوبة

Are non-compete and training repayment clauses valid under UAE labor law?
Q: Hello, My wife, who is on my dependent visa in the UAE, has received a job offer. She plans to remain on her dependent visa, and the hiring company has included additional terms in her employment contract. These terms include: - A two-year non-compete clause, preventing her from working in a competing business in the UAE after leaving the company. - A requirement to repay AED 10,000 for training costs if she resigns within one year of starting the job. - A clause stating that resigned or terminated employees will not receive any bonuses or incentives after leaving. - A disclaimer that any clause violating the UAE Labour Law (Decree-Law No. 33 of 2021) will be considered invalid. Are these conditions legally enforceable under UAE law? Can I include a statement to ensure both parties are legally safe? أسئلة وأجوبة

Will my father’s unpaid debts affect my re-entry to Dubai on a tourist visa?
Q: Hello, My father had some debts due in Dubai, and at that time, he was unable to pay them and still hasn’t. We left the country in 2017, but my mom and I were under his sponsorship, and we didn’t cancel our residency visas. Now I need to go back to Dubai on a work trip. I want to check if this might have any effect on me re-entering on a valid tourist visa. I’ve checked the ICP website, and it shows that my residence permit has been cancelled. أسئلة وأجوبة
